The meeting of the Planning and Zoning Commission on Tuesday, September 2, 2014, was
called to order at 5: 30 p.m. by Jerry Akers, Vice - Chairman.
A. The following members were present: Holland Harper, Jerry Akers, Mike Folmar,
James Price and Barney Bray
B. The following members were absent: John Lee and Billy Trenado
C. Also present were Shawn Napier, Director of Engineering, Planning and
Development; Alan Efrussy, Planning Manager; and Ashley Fendley, Secretary for
the Planning and Zoning Commission.
2. Approval of minutes from previous meetings. (August 4, 2014)
Motion was made by Mike Folmar, seconded by Jerry Akers to approve minutes for the
August 4, 2014 meeting. Motion carried 5 -0.
3. Public hearing and consideration of and action on the petition for the Historic District
Overlay (HD) for Reverend Michael Massey on behalf of Mt. Canaan Baptist Church, Lots
part of II and part of 12, Block 5, Texas & Pacific Addition, being located at 60 Sycamore
Street.
Public hearing was declared open.
A. One individual spoke in favor of the petition.
Reverend Michael Massey, of Paris, Texas, spoke in favor of the petition. Reverend
Massey stated Mt. Canaan Baptist Church has been in existence for 128 years and
would like to become a historical asset in the City of Paris.
B. No one spoke in opposition.
Public hearing was declared closed.
Motion was made by James Price, seconded by Barney Bray to approve the petition.
Motion carried 5 -0.
Motion was made by Holland Harper, seconded by Jerry Akers to recuse Mike Folmar
from items 4 and 5. Motion carried 4 -0
4. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Evans Addition CB
155, located at 417 W. Washington Street.
Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by
Jerry Akers, seconded by Barney Bray to approve the preliminary plat, subject to the City
Engineer's recommendations. Motion carried 4 -0.
5. Consideration of and action on the Final Plat of Lot 1, Block A, Evans Addition CB 155,
located at 417 W. Washington Street.
Shawn Napier reviewed the final plat with commissioners. Motion was made by James
Price, seconded by Barney Bray to approve the final plat, subject to the City Engineer's
recommendations. Motion carried 4 -0.
Motion was made by Jerry Akers, seconded by Barney Bray for Mike Folmar to return to
the meeting. Motion carried 4 -0
Motion was made by Holland Harper, seconded by Jerry Akers to recuse Holland Harper
from items 6 through 10. Motion carried 4 -0.
6 Consideration of and action on the Preliminary Plat of Lot 1, Block A, Turner Industries
Group LLC Addition 309, located at 1508 FM 137.
Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by
James Price, seconded by Barney Bray to approve the preliminary plat, subject to the City
Engineer's recommendations. Motion carried 4 -0.
7. Consideration of and action on the Final Plat of Lot 1, Block A, Turner Industries Group
LLC Addition 309, located at 1508 FM 137.
Shawn Napier reviewed the final plat with commissioners. Motion was made by Mike
Folmar, seconded by James Price to approve the final plat, subject to the City Engineer's
recommendations. Motion carried 4 -0.
8. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Lamar Power
Partners LP Addition, located at 3205 FM 137.
Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by
Barney Bray, seconded by Mike Folmar to approve the preliminary plat, subject to the City
Engineer's recommendations. Motion carried 4 -0.
9. Consideration of and action on the Final Plat of Lot 1, Block A, Lamar Power Partners LP
Addition, located at 3205 FM 137.
Shawn Napier reviewed the final plat with commissioners. Motion was made by Mike
Folmar, seconded by James Price to approve the final plat, subject to the City Engineer's
recommendations. Motion carried 4 -0.
10. Consideration of and action on the Master Plat of Lot 1, Block A, Lamar Power Partners
LP Addition, located at 3205 FM 137.
Shawn Napier reviewed the master plat with commissioners. Motion was made by Barney
Bray, seconded by James Price to approve the master plat, subject to the City Engineer's
recommendations. Motion carried 4 -0.
Motion was made by Mike Folmar, seconded by James Price for Holland Harper to return
to the meeting. Motion carried 4 -0.
11. Consideration of and action on the Master Plat of The Hill Subdivision.
Shawn Napier reviewed the master plat with commissioners. Motion was made by Barney
Bray, seconded by Mike Folmar to approve the master plat, subject to the City Engineer's
recommendations. Motion carried 5 -0.
12. Consideration of and action on the Preliminary Plat of Lot 5, 6, 10, 11 and 12, Block G and
K, The Hills Addition Phase 6, located in the 3300 Block off. K 33rd Street.
Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by
Barney Bray, seconded by James Price to approve the preliminary plat, subject to the City
Engineer's recommendations. Motion carried 5 -0.
13. Discussion session regarding proposed Cox Field Planned Development Airport Zoning
District Ordinance.
Alan Efrussy, Planning Manager presented the Cox Field Planned Development Airport
Zoning District Ordinance to the board members.
Part A. Goals and Objectives — This provides support for the permitting, not permitting, or
the requirement of Specific Use Permits for various land uses. The unique relationship of
aircraft activity in proximity to various land uses requires particular protections in
conjunction with developmental opportunities.
Part B. — Environmental Evaluation — This section strongly encourages all prospective
developers to review the documents listed to optimize both man —made and natural
environmental elements to protect eco— systems and structures of historic /cultural
importance, and to meet legal requirements regarding environmental protections.
Part C. — PuMRoses of each Subzone — This Planned Development zoning is comprised of
five separate subzones. The purpose of each subzone is described so that the
development and business communities, citizens, staff, and the planning and zoning
commission and city council can better appreciate what the physical development intent is
for the entirety of each subzone. This provides a basis for evaluating land use requests
for uses that are currently unlisted or to be created in the future. It also aids in the
refinement of developments that are currently permitted and /or that require a Special Use
Permit.
Part D. — Actual Ordinance Regulations — This is the heart of this ordinance. It indicates
land uses that are permitted, not permitted, or which require a Special Use Permit. It also
states requirements that address protection of life and/or property. The Goals and
Objectives in Part A have established the justification for allowing or disallowing (or
SDP's) many of the land uses in this ordinance.
Exhibits — These maps illustrate the five sub —zones of this ordinance, and graphically
portray their relationship to each other, and to their immediate environs.
Appendices — This information provides noise evaluation criteria; illustrations from the
Cox Field Master Plan to relate to this proposed zoning ordinance; and sources from the
Federal Aviation Administration that will help applicants in their development process.
The Planning and Zoning Commission had several concerns regarding pages 23 through
29 on the airport land use compatibility by zone chart. Motion was made by Holland
Harper, seconded by Mike Folmar to table the item till Monday, October 6, 2014 and to
have any revisions the board members would like to see changed turned into Alan Efrussy
by Tuesday, September 9, 2014. Motion carried 5 -0.
