2014-027 New Section 12-5, Seniority Pay to Chapter 12 Article 1, Fire Prevention and Protection, of the Code of Ordinances of the City of Paris, authorizing seniority step pay for fire fightersORDINANCE NO. 2014 -027 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ADDING A NEW SECTION 12 -5, SENIORITY PAY TO CHAPTER 12 ARTICLE 1, FIRE PREVENTION AND PROTECTION, OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS AUTHORIZING SENIORITY STEP PAY FOR FIRE FIGHTERS OF THE CITY OF PARIS; AND OTHER MATTERS RELATED TO THE SAME; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Fire Fighters of the Paris Fire Department are employed under a Civil Service System set out under Chapter 143 of the Texas Local Government code; and, WHEREAS, Section 143.041 of said Chapter 143 of the Local Government Code authorizes the governing body of a municipality to provide additional compensation to fire fighters based on longevity or seniority with the department; and WHEREAS, the City Council of the City of Parris approved a budget for FY 2014 -2015 which included seniority pay for fire fighters and police officers employed by the City of Paris, Texas; and WHEREAS, the City Council hereby approves a schedule of seniority pay for Fire Fighters, Driver /Engineers, Captains, Deputy Chiefs and the Fire Marshal as provided herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That a new Section 12 -5 "Seniority Pay' is hereby added to Chapter 12, Article I of the Code of Ordinances of the City of Paris, Texas, to read in its entirety as follows: "Sec. 12 -5. Seniority Pay. (a) Members of the Paris Fire Department below the rank of chief shall be entitled to receive seniority pay, based on their rank and years of service in that rank with the Paris Fire Department. The seniority pay will be in addition to each Fire Fighter's base pay as follows: (b) All Paris Fire Department civil service employees of the rank of Fire Fighter shall receive seniority pay in addition to their base pay calculated on their years of service with the Paris Fire Department at the Fire Fighter Rank, as follows: 1. Fire Fighters with one (1) or more years of service and less than three (3) years of service - Twenty-three dollars and eight cents ($23.08) per pay period. 2. Fire Fighters with three (3) years or more of service and less than five (5) years of service - twenty-six dollars and ninety-two cents ($26.92) per pay period. 3. Fire Fighters with five (5) years or more of service - Sixty -eight dollars and sixty-one cents ($68.61) per pay period. (c) All Paris Fire Department civil service employees of the rank of Driver /Engineer shall receive seniority pay in addition to their base pay calculated on their years of service with the Paris Fire Department at the Driver /Engineer rank, as follows: 1. Driver /Engineers with one (1) or more years of service and less than three (3) years of service - Twenty-three dollars and eight cents ($23.08) per pay period. 2. Driver /Engineers with three (3) years or more of service and less than five (5) years of service - twenty-six dollars and ninety-two cents ($26.92) per pay period. 3. Driver /Engineers with five (5) years or more of service - Sixty -eight dollars and sixty-one cents ($68.61) per pay period. (d) All Paris Fire Department civil service employees of the rank of Captain shall receive seniority pay in addition to their base pay calculated on their years of service with the Paris Fire Department at the Captain rank, as follows: 1. Captains with one (1) or more years of service and less than three (3) years of service - Twenty-three dollars and eight cents ($23.08) per pay period. 2. Captains with three (3) years or more of service and less than five (5) years of service - twenty-six dollars and ninety-two cents ($26.92) per pay period. 3. Captains with five (5) years or more of service - Sixty-eight dollars and sixty-one cents ($68.61) per pay period. (e) All Paris Fire Department civil service employees of the rank of Deputy Chief shall receive seniority pay in addition to their base pay calculated on their years of service with the Paris Fire Department at the Deputy Chief rank, as follows: 1. Deputy Chiefs with one (1) or more years of service and less than three (3) years of service - Twenty-three dollars and eight cents ($23.08) per pay period. 2. Deputy Chiefs with three (3) years or more of service and less than five (5) years of service - Twenty-six dollars and ninety-two cents ($26.92) per pay period. 3. Deputy Chiefs with five (5) years or more of service - Sixty -eight dollars and sixty -one cents ($68.61) per pay period. (f) All Paris Fire Department civil service employees of the rank of Fire Marshal shall receive seniority pay in addition to their base pay calculated on their years of service with the Paris Fire Department at the Fire Marshall rank, as follows: 1. Fire Marshal with less than fifteen (15) years of service - Seventy -two dollars and sixty five cents ($72.65) per pay period. 2. Fire Marshall with fifteen (15) or more years of service - Ninety -one dollars and twenty -two cents ($91.22) per pay period. (g) The seniority pay provided by this section shall be in addition to the regular base pay received by the member or members of the fire department qualifying for same." Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 6. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 7. This Ordinance does not demonstrate, nor is it any evidence of any intent to form a contract, unilateral or otherwise, with any civil service employee. This ordinance is enacted to comply with Chapter 143, Texas Local Government Code, specifically §143.041 and for no other purpose. Section 8. This ordinance shall become effective from and after its passage and publication as required by law. The seniority pay steps set out herein shall be effective with the first pay period in January 2015. PASSED AND ADOPTED this 8th day of December, 2014.
