12/05/2011 MINUTESMINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION CITY OF PARIS - CITY HALL COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, DECEMBER 5, 2011 5:30 O'CLOCK P.M. The regular meeting of the Planning and Zoning Commission on Monday, December 5, 2011, was called to order at 5:30 p.m. by Dennis Chalaire, Chairman. A. The following members were present: Holland Harper Jerry Akers Dennis Chalaire Keith Flowers James Price Richard Hunt B. The following members were absent: Keith Barnett C. Also present were Shawn Napier, P.E., Director of Engineering, Planning and Development; Jeanna Scott, Asst. Building Official; and Richard Grossnickle, Council Member. 2. Approval of minutes from previous meetings. (November 7, 2011) Motion was made by James Price, seconded by Richard Hunt to approve the meeting minutes for the November 7, 2011. Motion carried 6 -0. Motion was made by Keith Flowers, seconded by James Price to recuse Holland Harper from item 3. Motion carried 5 -0. 3. Public hearing and consideration of and action on the petition of We Reit, LLC for a change in zoning from a Heavy Industrial District (HI) to a Heavy Industrial District (HI) with a Specific Use Permit (53) Loading, unloading or transloading of crude oil, on Lots 1 -3, City Block 162; Lot 2, Block 1; Lot 1, Block 2; Lots 4 -8, Block 6, Lots I -10, Block 7; Lots 1 -11, Block 8, Lots 7-12, Block 9, Lots 1 -12, Block 10; Lots 1 -12, Block 11; Lots 1 -12, Block 12; Lots 1 -12, Block 13, Texas & Pacific Addition, being located between South Church Street, 6th Street S.E., Paris Boulevard and Union Pacific Railroad. Public hearing was declared open. A. The following individuals spoke in favor of the petition. Holland Harper, 1040 31" Street S.E., spoke in favor of the petition. Mr. Harper stated they have recently installed 1,400 feet of rail on the property. There are currently no contracts to receive crude oil at this time; however, in the near future they hope to be transloading oil from trucks to rail cars. Mr. Harper further stated that moving oil by rail car is more efficient because an oil truck only holds 5,500 gallons were a rail car will hold 30,000 gallons. The site will be a clean area maintained according to all regulations; it will be clean, safe and efficient. We Reit has a vested interest to make sure this operation is clean and safe because we live in the area and own property in the area. Mr. Harper stated their hope is to bring jobs to Paris as well. Commissioner Price asked how many jobs could be generated. Mr. Harper stated we are unsure at this time. Commissioner Chalaire asked if We Reit plans on storing oil on the property. Mr. Harper stated no not at this time, there will not be enough oil generated to need a storage facility. Trucks will come in unload the oil onto the rail car and return to the site to reload. B. No one spoke in opposition. Robert Burns, 507 South Church, had questions; however, stating Mr. Harper had answered those in his presentation. Public hearing was declared closed. Motion was made by Keith Flowers, seconded by James Price to approve the zoning change request. Motion carried 4 -0, 1 abstained. Motion was made by Richard Hunt, seconded by Dennis Chalaire to return Holland Harper to the meeting. Motion carried 5 -0. 4. Public hearing and consideration of and action on the petition of Jim Noble, for a change in zoning from a Neighborhood Service District (NS) to a General Retail District (GR) on Lots South Part of I and South Part West 25' of 3, City Block 201, being located at 2246 Bonham Street. The public hearing was declared open. A. The following individuals spoke in favor of the petition. Jim Noble, 3345 East Houston, spoke in favor of the petition. Mr. Noble stated he operated a hardware store at this location for 28 years. Recently he leased the building and found out that the zoning was incorrect, therefore they are here to ask for a zoning change. Robert Burns, 507 South Church, spoke in favor of the petition. Mr. Burns stated this has been a business for several years. B. No spoke in opposition. Public hearing was declared closed. Motion was made by Holland Harper, seconded by James Price to approve the zoning change request. Motion carried 6 -0. S. Consideration of and action on the Replat of Lots 1, 2, and 3; Block A, Hindman Park Addition, being located in the 700 Block of 41" Street S. W. Motion was made by Holland Harper, seconded by Jerry Akers to approve the Replat, subject to the City Engineer's recommendations. Motion carried 6 -0. 6 Consideration of and action on the Re -Plat of Lots 4, S, 6, and 7, Block 10, Neagle Addition, being located at 1744 South Church Street. Motion was made by Holland Harper, seconded by Keith Flowers to approve the Replat, subject to the City Engineer's recommendations. Motion carried 6 -0. 7.
