1. The Board of Adjustment meeting was called to order by Chairman Terry Christian at
12:00 p.m.
A. The following members were present:
Terry Christian, Chairman
Chester Martindale
Kyle McCarley
Rick Hundley
Allen Moore
B. The following members were absent:
David Glass
C. Also present was Jeanna Scott, City Staff.
2. Approval of minutes from previous meetings. (October 6, 2009)
Motion was made by Chester Martindale, seconded by Rick Hundley to approve the
minutes for the October 6, 2009 meeting. Motion carried 5 -0.
3. Public hearing and consideration of and action on the petition of Kings Sports & Awards
to grant a variance of Zoning Ordinance No. 1710, Section 10 -10269 to reduce the
required number ofparking spaces. from "one (1) space for each two hundred (200) square
feet of floor area, " to one (1) space for each two hundred ninety -nine (299) square, feet of
floor area, on Lot IOA, City Block 266, being number 2330 Loop 286 N.E.
Public hearing was declared open.
A. The following individuals spoke in favor of the petition.
Garland Lamb, 3460 Pine Bluff, Mr. Lamb stated they are adding private offices to
the back of their building. There will not be any increase in customers, addition is
for the use of existing employees.
B. There was no opposition.
Public hearing was declared closed.
Motion was made by Rick Hundley, seconded by Allen Moore to approve the variance
request. Motion carried 5 -0.
4. Public hearing and consideration of and action on the petition of Kroger to grant a
variance of Sign Ordinance No. 2008 -021, Section 28 -8(h) which provides that the "total
sign face area of all permanent signs, combined on one property, including ground signs,
pole signs, attached signs, etc. shall not exceed one (1) square foot per front foot of
property line, or a maximum of three hundred (300) square feet, at any time, " to allow 1.32
square feet of sign face area per front foot of property, on Lot 1, Block A, Kroger Addition,
being number 1310 Clarksville Street.
Public hearing was declared open.
A. The following individuals spoke in favor of the petition.
Jerry, Kroger, Jerry stated they are changing and moving the existing pole sign.
Kroger has shrunk the signage to the minimum allowable for their company.
B. No one spoke in opposition.
Public hearing was declared closed.
Motion was made by Kyle McCarley, seconded by Chester Martindale to approve the
variance request. Motion carried 5 -0.
Public hearing and consideration of and action on the petition of Terry Ragan to grant a
variance of Zoning Ordinance No. 1710, Section 9- 602(6), to modify the required side yard
setback from S' to 2' on Lot 4, Block B, C.C. Rainey Addition, being number 3240 East
Houston.
Public hearing was declared open.
A. The following individuals spoke in favor of the petition.
Terry Ragan, 3240 East Houston, Mr. Ragan stated his father put up this carport
before he died. His father must not have been aware that he needed a permit or
that it was in the setback.
B. No one spoke in opposition.
Public hearing was declared closed.
Motion was made by Chester Martindale, seconded by Rick Hundley to approve the
variance request. Motion carried 5 -0.
5. Meeting adjourned at 12:10 p.m.
