The Planning and Zoning Commission met Monday, February 1, 1999 at 5:30 in the City
Hall - Council Room, Paris, Texas with the following members present:

Earl Smith, the City Engineer and Scott Foster, the City Attorney, were also present.
The meeting was called to order by Reeves Hayter.
The minutes from the January 4, 1999, regular planning and zoning meeting were
approved with a motion by Curtis Fendley and seconded by Joe McCarthy.
Motion carried by a vote of 9 ayes and 0 nays.
2. Public Hearing to consider the petition of Vickie Thompson for a change in
zoning from a One - Family Dwelling District No. 3 (SF -3) to a One - Family
Dwelling District No. 3 (SF -3) With Specific Use Permit (39) Mobile Home,
Lot 8, Block 1, Few Addition, being number 1235 N.W. 18th Street.
The public hearing was declared open.
Ms. Vickie Thompson spoke in favor of the petition stating that the lot belongs to
her parents and there are other mobile homes in the area. She wants to live on
property to care for it.
There was no opposition, the public hearing was declared closed.
3. Consideration of and action on the petition of Vickie Thompson for a change
in zoning from a One - Family Dwelling District No. 3 (SF -3) to a One - Family
Dwelling District No. 3 (SF -3) With Specific Use Permit (39) Mobile Home,
Lot 8, Block 1, Few Addition, being number 1235 N.W. 18th Street.
Motion was made to approve by Bobby Myers and seconded by Louis Yates.
Motion carried by a vote of 9 ayes and 0 nays.
4. Public Hearing to consider the petition of Wayne Brown for a change in
zoning from a One - Family Dwelling District No. 2 (SF -2) and-General Retail
District (GR) to a Multiple Family Dwelling District No. 1 (MF -1), Lots 2, 3,
4, City Block 243, being number 2500 Bonham Street.
The public hearing was declared open.
Mr. Wayne Brown, 3755 N.E. Loop 286, representing Pshigoda Foundation,
spoke in favor of the petition. The Pshigoda Foundation builds affordable
housing for the elderly. There are many on the waiting list. The Foundation
wants to build 25 units but contract to buy the property is contingent on zoning.
There was no opposition, the public hearing was declared closed.
5. Consideration of and action on the petition of Wayne Brown for a change in
zoning from a One - Family Dwelling District No. 2 (SF -2) and General Retail
District (GR) to a Multiple Family Dwelling District No. 1 (MF -1), Lots 2, 3,
4, City Block 243, being number 2500 Bonham Street.
Motion was made to approve by Curtis Fendley and seconded by Michael
Dangerfield. Motion carried by a vote of 9 ayes and 0 nays.
6. Public Hearing to consider the petition of the City of Paris for a change in
zoning from a Multiple Family Dwelling District No. 1 (MF -1) to a Public
Lands and Institutions District (PLI), Lot 1, City Block 152, being number
829 Brame.
The public hearing was declared open.
Earl Smith, the City Engineer, spoke in favor of the petition explaining that a coin
operated laundry is to be built and to be administered by Paris Housing Authority.
The project will be funded in part by a Grant from TDCP as part of the Young vs
Cisneros settlement.
Mr. Skipper Steely, 801 W. Sherman, opposed the zoning change. He is afraid of
it being a gathering place for drug dealing juveniles. He requested that George
Wright name be removed from Paris Housing Authority complex. He would like
the whole complex fixed up, landscaped, etc. Mr. Steely presented a letter in
opposition to the petition.
Gary Nelson, 557 7th S.W., opposed the petition complaining of traffic on 7th
S.W. He fears traffic increase.
Robert Newman, 556 7th S.W., asked why not use the grocery store on W.
Washington. He fears the laundry would be torn up.
Curtis Fendley was excused from consideration of this item. Motion made by Joe
McCarthy and seconded by Louis Yates. Motion carried by a vote of 8 ayes and 0
nays.
7. Consideration of and action on the petition of the City of Paris for a change
in zoning from a Multiple Family Dwelling District No. 1 (MF -1) to a Public
Lands and Institutions District (PLI), Lot 1, City Block 152, being number
829 Brame.
Motion was made to table item by Bill Coleman and seconded by Marshall Kent,
request was made for Paris Housing Authority to attend next meeting to explain
reasons. Motion carried by a vote of 8 ayes and 0 nays.
Motion was made by Joe McCarthy and seconded by Marshall Kent for Curtis
Fendley to return. Motion carried by a vote of 8 ayes and 0 nays.
Public Hearing to consider the petition of Monte Moore for a change in
zoning from an Agricultural District (A) to a Multiple Family Dwelling
District No. 1 (MF -1) and Planned Development al Commercial District (PD-
al), Pt. of Lot 5, City Block 318, being numbers 1100 thru 1300 N.E. 34th
Street.
The public hearing was declared open.
Mr. Monte Moore, 2010 Lamar Avenue, spoke in favor of the petition, also
handed out small drawing of what he intended to do with the property. He wants
rezoning considered as two separate issues. He would like Multiple Family
zoning along 34th N.E. and Commercial Center (PD -al) along Loop 286. Would
like 120 feet deep along 34th N.E. rezoned for Multiple Family. A sketch was
shown of Commercial Center, approximately 250 x 250 for mini warehouses and
RV storage. A surface water runoff study done by Chaney Engineering as well as
a letter showing that Chaney was retained was also presented. Mr. Moore stated
that progress does impact traffic but rezoning and progress must proceed. He
expects his project will add $2,000,000 to tax base. He intends to leave the
remainder of the property as Agriculture.
Ms. Jackie Wood, 3415 Vegas Drive, spoke in opposition to the petition stating
that he was concerned with traffic, however, he was not opposed to Single Family
zoning. She is against Commercial zoning with access from 34th N.E.
Ms. Patsy Guest, 1815 34th N.E., spoke in opposition. She has 45 acres north of
the project and wonders why the best use for the property couldn't be residential.
She feels Planned Development would allow everybody to completely understand
what is proposed prior to the project. Ms. Guest thinks that storage building
would allow night lighting and there would be traffic all night.
Mr. Edward Woemer, 3410 Fargo, opposed stating that he is afraid Multiple
Family zoning would greatly increase traffic but he is not opposed to Single
Family zoning if housing is similar to neighborhood.
Ms. Mary Montgomery, 1570 34th N.E., opposes stating that at the existing
duplexes in the neighborhood, there is always something going on late at night.
9. Consideration of and action on the petition of Monte Moore for a change in
zoning from an Agricultural District (A) to a Multiple Family Dwelling
District No. 1 (MF -1) and Planned Development al Commercial District (PD-
al), Pt. of Lot 5, City Block 318, being numbers 1100 thru 1300 N.E. 34th
Street.
Motion made to approve except change Multiple - Family Dwelling District No. 1
(MF -1) to Two - Family Dwelling District (217) along 34th N.E. Motion was made
by Louis Yates and seconded by Michael Dangerfield. Motion failed with a vote
of 4 ayes and 5 nays.
10. Public Hearing to consider the petition of John Mark Spencer for a site plan
approval, Lots 3 and 4, Block 4, S. J. Wright's Addition, being number 1825
Bonham Street.
The public hearing was declared open.
John Mark Spencer spoke in favor of the petition stating that the property used to
have old car wash, dilapidated and torn down. He tried to sell property but now
he wants to build mini warehouses. Buildings would be built like B.J. Floyd's
building in Momingside and would comply with greenspace requirements.
Walter Cooper, property chairman for Immanuel Baptist Church, states he is not
opposed as long as he complies with city ordinance.
11. Consideration of and action on the petition of John Mark Spencer for a site
plan approval, Lots 3 and 4, Block 4, S. J. Wright's Addition, being number
1825 Bonham Street.
Motion made to approve subject to City Engineer's memo dated February 1, 1999
and include screening fence along south property line. Motion carried by a vote of
9 ayes and 0 nays.
Motion made to excuse Reeves Hayter from the meeting and Curtis Fendley now
chairs meeting. Motion carried by a vote of 8 ayes and 0 nays.
12. Consideration of and action on recommendation of the Final Plat of Lots 36
and 35, Block L, Lots 6 and 3, Block K, and Lots 6 and 7, Block J, Oak
Creek Pt. of Phase VII.
Motion made to approve, subject to City Engineer's memo dated February 1,
1999, by Marshall Kent and seconded by Joe McCarthy. Motion carried by a vote
of 8 ayes and 0 nays.

2. Public Hearing to consider the petition of George Rance Pomroy for a change in zoning
from an Agriculture District (A) to a One - Family Dwelling District No. 3 (SF -3) With
Specific Use Permit (39) Mobile Homes, Lot 28, City Block 323, being number 3225 NW
19`h Street.
The public hearing was declared open.
Rance Pomroy, 410 E. Washington, spoke in favor of the petition stating he wants a mobile
home located there for his mother who needs to be close by to ease caretaking.
There was no opposition, the public hearing was declared closed.
3. Consideration of and action on the petition of George Rance Pomroy for a change in
zoning from an Agriculture District (A) to a One - Family Dwelling District No. 3 (SF -3)
With Specific Use Permit (39) Mobile Homes, Lot 28, City Block 323, being number

Motion was made to approve by Curtis Fendley and seconded by Cesar Horta. Motion
carried by a vote of 5 ayes and 0 nays.
4. Public Hearing to consider the petition of Brandy Draper for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a Multiple - Family Dwelling District No.
1 (MF -1), Lot 4, City Block 257, being number 2208 East Cherry.
The public hearing was declared open.
There was no one present to speak in favor of the petition.

5. Consideration of and action on the petition of Brandy Draper for a change in zoning
from a One - Family Dwelling District No. 2 (SF -2) to a Multiple- Family Dwelling

Motion was made to table by Curtis Fendley and seconded by Cesar Horta. Motion carried
by a vote of 5 ayes and 0 nays.
6. Public Hearing to consider the petition of H.C. Reaves, Jr. for a change in zoning from
an Agricultural District (A) to a Commercial District (C), Lot 19, City Block 324, being
number 2915 FM 79.
The public hearing was declared open.
Mr. & Mrs. H.C. Reaves, Jr., Box 309B, Rt. 5, Paris, spoke in favor of petition wanting
commercial zoning for sale to person who wants to build a carwash.
Ms. Isabelle Sims, Rt. 1, Paris, states petition is ok with her.
Marshall Suggs, Rt. 1, Sumner, wants to buy property to construct a carwash.
Mr. Bobby Smallwood, 1130 Levi Lane, will build the facility.
There was no opposition, the public hearing was declared closed.
7. Consideration of and action on the petition of H.C. Reaves, Jr. for a change in zoning
from an Agricultural District (A) to a Commercial District (C), Lot 19, City Block 324,
being number 2915 FM 79.
Motion was made to approve by Curtis Fendley and seconded by Louis Yates, Jr. Motion
carried by a vote of 5 ayes and 0 nays.
8. Public Hearing to consider the petition of Randy Brown for a change in zoning from
a General Retail District (GR) to a General Retail District (GR) With Specific Use
Permit (52) Signs and Billboards, Lot 1, City Block 347, being number 4025 Clarksville
Street.
The public hearing was declared open.
Mr. Randy Brown, Rt. 2, Box 101, Paris, wants to allow billboard sign construction next to
where old railroad bridge was.
There was no opposition, the public hearing was declared closed.
9. Consideration of and action on the petition of Randy Brown for a change in zoning
from a General Retail District (GR) to a General Retail District (GR) With Specific Use
Permit (52) Signs and Billboards, Lot 1, City Block 347, being number 4025 Clarksville
Street.
Motion was made to approve by Bill Coleman seconded by Curtis Fendley. Motion carried
by a vote of 5 ayes and 0 nays.
10. Public Hearing to consider the petition of Tracy Bratcher for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a Two - Family Dwelling District (2F),
Lot 27A, Block 5, Mayer Addition, being number 100 NW 34th Street.
Mike Dangerfield joined meeting.
The public hearing was declared open.
Mr. Tracy Bratcher, 406 SW 9t'', Paris, wants to build 1800 SF, brick duplex on property.
The lot is presently vacant. There is a possibility of splitting the lot into 2 lots and building
2 duplexes.
Mr. James Shamblin, 150 NW 34t'', presented a petition with 14 names of neighbors
opposing. They want to keep Single Family zoning.
There was no further opposition, the public hearing was declared closed.
11. Consideration of and action on the petition of Tracy Bratcher for a change in zoning
from a One - Family Dwelling District No. 2 (SF -2) to a Two - Family Dwelling District
(2F), Lot 27A, Block 5, Mayer Addition, being number 100 NW 34" Street.
Motion was made to deny by Curtis Fendley seconded by Louis Yates, Jr. Motion carried
by a vote of 6 ayes and 0 nays.
12. Public Hearing to consider the petition of Vicki E. Banister for a change in zoning from
a Two - Family Dwelling District (2F) to a One - Family Dwelling District No. 3 (SF -3)
With Specific Use Permit (39) Mobile Homes, Lot 2, Block 5, Locust Hill Addition,
being number 920 SW 4" Street.
13. Consideration of and action on the petition of Vicki E. Banister for a change in zoning
from a Two -Family Dwelling District (2F) to a One - Family Dwelling District No. 3 (SF-
3) With Specific Use Permit (39) Mobile Homes, Lot 2, Block 5, Locust Hill Addition,
being number 920 SW 4" Street.
Petitioner withdrew petition.
14. Public Hearing to consider the petition of Terry Dulaney for a site plan approval, Lots
5, 6, & 7, Block 8, Spring Lake Addition, being number 210 N. Collegiate.
The public hearing was declared open.
Mr. Terry Dulaney spoke in favor of the petition.
There was no opposition, the public hearing was declared closed.
15. Consideration of and action on the petition of Terry Dulaney for a site plan approval,
Lots 5, 6, & 7, Block 8, Spring Lake Addition, being number 210 N..Collegiate.
Motion was made to approve by Curtis Fendley and seconded by Mike Dangerfield subject
to the City Engineer's Memo dated June 30, 1999. Motion carried by a vote of 6 ayes and
0 nays.
Motion was made by Bill Coleman and seconded by Louis Yates to excuse Curtis Fendley
from the meeting.
16. Consideration of and action on recommendation on the closing of 8th Street NE from
the north boundary line of Martin Luther King Jr. Drive, north to the south boundary
line of Hickory Street.
Ms. Christa Cherry, representing Paris Housing Authority, explained that they want to put
up gates to limit access from outsiders to complex. She has talked with Paris Independent
School District and Mr. Murkes Fulbright who owns property across the street, neither
objects to the street closing. Gates will be operated with a key card.
Motion was made to approve by Bill Coleman and seconded by Louis Yates with compliant
of fire code. Motion carried by a vote of 5 ayes and 0 nays.
17. Consideration of and action on recommendation on the closing of Brame Street from
the east boundary line of 9" Street SW, west to the west boundary line of 10th Street
SW, Chism Street from the west boundary line of 7" Street SW, west to the east
boundary line of 10" Street SW; 9th Street SW, from the north boundary line of Chism
Street, north of the south boundary line of Brame Street; and 10' Street SW; from the
north boundary line of Washington Street north to the south boundary line of Brame
Street.
Ms. Christa Cherry, for George W. Wright Homes, explained that the entrance would be at
7`t' SW at Chisum. Ms. Cherry has talked with most of the neighborhood residents and they
all are in favor of the street closing. Skipper Steely was present and stated his support.
Mike Dangerfield suggested a second gate at 10th SW and Washington.
Motion was made to approve by Bill Coleman and seconded by Louis Yates with compliant
of fire code. Motion carried by a vote of 5 ayes and 0 nays.

to the meeting. Motion carried by a vote of 6 ayes and 0 nays.

Motion was made to approve by Curtis Fendley and seconded by Louis Yates subject to the
City Engineer's Memo dated August 2, 1999. Motion carried by a vote of 7 ayes and 0
nays.

258.
Motion was made to approve by Curtis Fendley and seconded by Michael Dangerfield
subject to the City Engineers's Memo dated August 2, 1999. Motion carried by a vote of 7
ayes and 0 nays.
9. Consideration of and action on the recommendation of the Final Plat, Lot 9, Block I
and Lot 8, Block J, Oak Creek Subdivision, Phase VII.
Motion was made to approve by Bobby Myers and seconded by Louis Yates subject to the
City Engineer's Memo dated August 2, 1999. Motion carried by a vote of 7 ayes and 0
nays.
Motion was made for Reeves Hayter to return to the meeting. Motion carried by a vote of

The minutes from the November 1, 1999, regular planning and zoning meeting were
approved with a motion by Joe McCarthy seconded by Bobby Myers. Motion carried by a
vote of 7 ayes and 0 nays.
Chairman Reeves Hayter entered the meeting at 5:40 and presided thereafter.
2. The next item was tabled at the November 1, 1999, meeting. Motion was made by
Bobby Myers and seconded by Joe McCarthy to bring item from table. Motion carried
by a vote of 8 ayes and 0 nays.
3. Public Hearing to consider the petition of Eric Clifford for a change in zoning from a
One - Family Dwelling District No. 2 (SF -2) to a Two - Family Dwelling District (2F), Lots
5, 6, 7, & 8, Block 7 and Lots 8, 9. & 10, Block 8, Springlake Addition, being the 300
Block N. Collegiate.
The public hearing was declared open.
Eric Clifford, 3065 Oak Creek Drive, spoke in favor of the petition stating that he bought the
lots from the City by bid and thought they were already zoned Two - Family (217) which is
needed to build duplexes (1250 S.F. with side garages)
There was no opposition, the public hearing was declared closed.
4. Consideration of and action on the petition of Eric Clifford for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a Two - Family Dwelling District (2F),
Lots 5, 6, 7, & 8, Block 7 and Lots 8, 9. & 10, Block 8, Springlake Addition, being the
300 Block N. Collegiate.
Motion was made to approve by Marshall Kent and seconded by Michael Dangerfield.
Motion carried by a vote of 8 ayes and 0 nays.
5. Public Hearing to consider the petition of April Helms for a change in zoning from a
One - Family Dwelling District No. 2 (SF -2) to a One -Family Dwelling District No. 2 (SF-
2) With Specific Use Permit (25) Nursery and Daycare, Lot 4, Block A, York Addition,
being number 335 York Street.
The public hearing was declared open.
April Helms, 335 York Street, spoke in favor of the petition stating that she wants to provide
a daycare in her home to care for up to 12 children and her home meets requirements for 12
children. She will not add onto house or erect any signs.
Susan Baldwin, 325 York Street, asked questions regarding business hours and if there were
any stipulations —there were none. She also asked if zoning remained with property if the
resident moved away, the answer was, "yes ". She has a dog and was concerned with
children sticking their hands through the fence and being bitten. Mr. Helms said a wooden
fence would be built to prevent this.
6. Consideration of and action on the petition of April Helms for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a One - Family Dwelling District No. 2
(SF -2) With Specific Use Permit (25) Nursery and Daycare, Lot 4, Block A, York
Addition, being number 335 York Street.
Motion was made to approve by Michael Dangerfield and seconded by Louis Yates. Motion
carried by a vote of 8 ayes and 0 nays.
7. Consideration of and action on recommendation of the Final Plat, Brownwood Village,
Phase 4.
Motion was made to approve by Bobby Myers and seconded by Joe McCarthy subject to the
City Engineer's Memo dated December 6, 1999.
