DECEMBER 4, 2000
The Planning and Zoning Commission met Monday, December 4, 2000 at 5:30 at Paris Junior
College, Applied Technology Building, Rm. 1016, 2400 Clarksville Street, Paris, Texas with the
following members present:
1. Reeves Hayter

4. Eddie Vincent
5. Marshall Kent
6. Bobby L. Myers
7. Louis Yates, Jr.
Steve Methven, the building official was also present.
The meeting was called to order by Reeves Hayter.
1. The minutes from the November 6, 2000 regular planning and zoning meeting were
approved with a motion by Curtis Fendley seconded by Bobby Myers. Motion carried by a
vote of 7 ayes and 0 nays.
2. Public Hearing to consider the petition of Don A. Ensey for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a Light Industrial District (LI), Lot 1,
City Block 276, being the 1100 Block of Clement Road.
The public hearing was declared open.
Don Ensey spoke in favor of the petition stating that his plans are to clean up property and
later build metal buildings for service type businesses with commercial storage at rear of
property. There is no agreement for any type of business at this time. Mr. Ensey stated that
this property could not be developed for single family houses.
There was no opposition, public hearing was declared closed.
3. Consideration of and action on the petition of Don A. Ensey for a change in zoning
from a One - Family Dwelling District No. 2 (SF -2) to a Light Industrial District (LI),
Lot 1, City Block 276, being the 1100 Block of Clement Road.
Motion was made to approve by Bobby Myers and seconded by Eddie Vincent. Motion
carried by a vote of 7 ayes and 0 nays.
4. Public Hearing to consider the petition of Ray Spencer for a change in zoning from a
One - Family Dwelling District No. 2 (SF -2) to a General Retail District (GR), Lot 12,
City Block 222 -B, being number 2636 E. Price.
The public hearing was declared open.
Ray Spencer spoke in favor of the petition stating that he already owns property around this
lot and would like to make all of the property the same. He has no specific purpose for this
property at this time.
There was no opposition, the public hearing was declared closed.
5. Consideration of and action on the petition of Ray Spencer for a change in zoning from
a One - Family Dwelling District No. 2 (SF -2) to a General Retail District (GR), Lot 12,
City Block 222 -B, being number 2636 E. Price.
Motion was made to approve by Curtis Fendley and seconded by Louis Yates, Jr. Motion
carried by a vote of 6 ayes and 1 nay.
6. Public Hearing to consider the petition of Gene Hertzog for a change in zoning from
an Agricultural District (A) to an Agricultural District (A) With Specific Use Permit
(25) Day Care Center, being the 400 Block of County Road 32900.
The public hearing was declared open.
Ms. Elizabeth Hertzog spoke in favor of the petition stating that she wants to build a day care
for mentally retarded adults (no children). The day care will be licensed by the state with
Ms. Hertzog's daughter working there as a registered nurse.
Chairman Reeves Hayter expressed concerns regarding the small road going to the property.
Ms. Hertzog does not think the road will be a problem.
There was no opposition, the public hearing was declared closed.
7. Consideration of and action on the petition of Gene Hertzog for a change in zoning
from an Agricultural District (A) to an Agricultural District (A) With Specific Use
Permit (25) Day Care Center, being the 400 Block of County Road 32900.
Motion was made to approved by Eddie Vincent and seconded by Bobby Myers. Motion
carried by a vote of 7 ayes and 0 nays.
8. Public Hearing to consider the site plan approval requested by Terry Jacobs, Part of
Lot 14, City Block 259, being the 2900 Block NE Loop 286.
9. This item was tabled at the November 6, 2000 meeting. Should the Commission wish
to consider this matter tonight, a motion to bring this item from the table is required.
Motion was made by Curtis Fendley for the item to be brought from the table and seconded
by Louis Yates, Jr. Motion carried by a vote of 7 ayes and 0 nays.
The public hearing was declared open.
Larry Cates spoke in favor of the site plan approval for HWH Investments. Mr. Cates made
a presentation of the proposed shopping center. A specific site plan for Home Depot was
presented showing the trees being left as a buffer for the residential area along N. Collegiate
Street. Drainage issues were addressed with water being retained on the property. All
drainage will flow into ponds and no more water than at present rate will flow off property.
The design is for a 25 year flood plan.
Barry Owen, 3015 Briarwood, expressed concerns regarding fencing stating that he did not
think that the fence would be maintained and Wal Mart fence was sited as not being properly
taken care of. Mr. Owen was also concerned that the entrance off N. Collegiate would
increase traffic.
Jeff Starnes, 3025 Briarwood, did not oppose the shopping center but wants safeguards for
the neighborhood. Mr. Starnes would like to see a stone or brick fence built on the south
property line. Mr. Starnes is also concerned about fence maintenance and 30`h NE and 31"
NE providing entrance to the back of the shopping center. Mr. Starnes thinks that delivery
should be at the side of the building, not in the rear and hours should be restricted.
Richard Manning, 2965 Cypress, is concerned about entrance to the shopping center off N.
Collegiate. He thinks it will be a death trap. He wants to see a brick wall (fence) to screen
houses from the shopping center. Mr. Manning thinks that lighting should be arranged so
as to not be intrusive on the adjacent neighbors. Again, Mr. Manning stated that he does not
want access from N. Collegiate to the shopping center.
Bill O'Neal, 1220 N. Collegiate, was not opposed to the shopping center but would like to
see the creek cleaned up.
There was no opposition, the public hearing was declared closed.
10. Consideration of and action on the site plan approval requested by Terry Jacobs, Part
of Lot 14, City Block 259, being the 2900 Block NE Loop 286.
Motion was made to approve by Curtis Fendley and seconded by Louis Yates, Jr. with
developers working with the Engineer's office regarding lighting and building a 6' fence on
the south side and keeping the green belt on the west side as shown. Motion carried by a
vote of 7 ayes and 0 nays.
11. Consideration of and action on recommendation of the Preliminary Plat, Paris Towne
Crossing Addition, Lots 1 -7, Block 1, being the 3000 Block NE Loop 286.
Motion was made to approve by Curtis Fendley and seconded by Marshall Kent, subject to
the Building Official's memo dated, November 29, 2000. Motion carried by a vote of 7 ayes
and 0 nays.
