10 - DELINQUENT TAX ATTORNEY CONTRACT EXTENSIONItem No. 10 �emorandum TO: Mayor & City Council FROM: John Godwin, City Manager SUBJECT: DELINQUENT TAX ATTORNEY CONTRACT EXTENSION DATE: March 2, 2015 BACKGROUND: In 2013 we replaced our previous delinquent tax attorneys with The Pounders Law Firm. Tracy Pounders has been much more aggressive and active with our accounts, has introduced new innovative techniques, and will not simply forgive personal property taxes as the previous vendor commonly did. STATUS OF ISSUE: The existing agreement with Pounders will expire soon, so we have agreed to a contract extension in order to continue this mutually beneficial business relationship. BUDGET: Contract costs are paid from collected delinquent taxes, penalties, and interest. RECOMMENDATION: Approve attached resolution and first contract amendment. RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, EXTENDING THE INITIAL TERM OF A SERVICES CONTRACT WITH THE POUNDERS LAW FIRM, PLLC, FOR THE COLLECTION OF DELINQUENT PROPERTY TAXES; MAKING OTHER FINDINGS AND PROVISIONS AND DECLARING AN EFFECTIVE DATE. WHEREAS, on April 22, 2013, the City of Paris (the "CITY ") entered into a contract with The Pounders Law Firm, PLLC, (the "LAW FIRM ") to enforce the collection of all delinquent taxes, penalty and interest as authorized by the Texas Property Tax Code ( "the Contract "); and WHEREAS, the initial term of the Contract expires on October 1, 2015; and WHEREAS, the CITY desires that the LAW FIRM continue enforcing the collection of its delinquent taxes penalties and interest under the Contract; NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of Paris, Texas, that: Section 1. The attached First Amendment to the Contract between the CITY and the LAW FIRM is hereby APPROVED, extending the initial term of the Contract to October 1, 2020. Section 2. This Resolution shall take effect immediately after its passage in accordance with the provisions of law. PASSED AND APPROVED this 9th day of March, 2015. Kent McIlyar, City Attorney THE STATE OF TEXAS § FIRST AMENDMENT § CONTRACT FOR THE § COLLECTION OF DELINQUENT COUNTY OF LAMAR § PROPERTY TAXES THIS FIRST AMENDMENT TO CONTRACT is made and entered into by and between the CITY OF PARIS, TEXAS a Texas homerule municipality located in Lamar County, Texas, acting herein by and through its City Council (hereinafter called the "CITY ") and THE POUNDERS LAW FIRM, PLLC (hereinafter called the "LAW FIRM ") acting by and through its duly authorized officers. WITNESSETH: WHEREAS, on April 22, 2013, the City of Paris (the "CITY ") entered into a contract with The Pounders Law Firm, PLLC, (the "LAW FIRM ") to enforce the collection of all delinquent taxes, penalty and interest as authorized by the Texas Property Tax Code ( "the Contract "); and WHEREAS, the initial term of the Contract expires on October 1, 2015; and WHEREAS, the CITY desires that the LAW FIRM continue enforcing the collection of its delinquent taxes penalties and interest under the Contract; THEREFORE IT IS AGREED THAT: SECTION 1. The initial term expiration date specified in Section 7 of the Contract shall be October 1, 2020, rather than October 1, 2015. SECTION 2. All other provisions of the Contract shall remain the same.
