03/02/2015 MINUTESMINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION CITY COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, MARCH 2, 2015 5:30 O'CLOCK P.M. The meeting of the Planning and Zoning Commission on Monday, March 2, 2015, was called to order at 5:3 O p. m. by Jerry Akers, Vice - Chairman. A. The following members were present: Jerry Akers, John Lee, Barney Bray, Mike Folmar and Billy Trenado B. The following members were absent: Holland Harper and James Price C. Also present were Shawn Napier, Director of Engineering, Planning and Development; Sue Lancaster, City Council; Joey Sleeper, Building Official; and Triniti Frazier, City Staff. 2. Approval of minutes from previous meetings. (February 2, 2015; February 17, 2015) Motion was made by Mike Folmar, seconded by John Lee to approve minutes for the February 2, 2015 and February 17, 2015 meeting, with corrections. Motion carried 5 -0. 3. Public hearing and consideration ofand action on the petition of Don Howell for a change in zoning from Neighborhood Service District (NS) to a Commercial District (C) on Lot 4A, City Block 354, located at 4100 S. E. Loop 286 Public hearing was declared open. A. One individual spoke in favor of the petition. Don Howell, 115 Airport Road Reno, Texas, spoke in favor of the petition. Mr. Howell stated this property has been in their family for forty (40) years. The maps show it to be in the flood plain but it has been removed from that area with the help of the City. It has been zoned Neighborhood Service (NS) because his brother had a portable building there and ran a real estate office out of it. He has wanted to build the property up for the past twenty (20) years. With sewer services going to be available for this property it would be a good location for a free standing structure such as a flooring shop, hair studio, sandwich shop, etc. Mr. Howell further stated he wants to have opinions for his property. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Barney Bray, seconded by Billy Trenado to approve the petition. Motion carried 5 -0. 4. Public hearing and consideration of and action on the petition of Paris Lakes Medical Center, LLC for a change in zoning from Agricultural District (A) and a One - Family Dwelling District No. 2 (SF -2) to a Commercial District (C) on 40 acres in the A524 J Leach Survey, being Part of Tract I and 4, located at 2675 SE 41St Street. Public hearing was declared open. A. One individual spoke in favor of the petition. Ron Parker, 691 CR 1242 Detroit, Texas, spoke in favor of the petition. Mr. Parker stated after three and a half (3 I/2) years they are finally here. This hospital (medical office buildings) will have two hundred and twelve thousand (212,000) square feet of office space and one hundred and eighty thousand (180,000) square feet of hospital (medical office buildings) space. The structure is eighty (80) percent leased already, excluding the retail and hotel area. They have several hotel operators that are willing to commit but are looking for one that will work with the hospital and have decent rates for families. The choices for the hotel are between the Embassy Suites, Marriot, or the Hyatt Place. Their Architect is HKS (Harwood K. Smith), which is largest and oldest hospital architect in the world. They are using Thompson Engineering out of Atlanta, Georgia. Mr. Parker further stated that they are trying to keep most of the work local with Harrison, Walker & Harper being the general contractors. The management company will be his own company Mr. Parker stated. Barney Bray asked if he has spoken with the Highway Department. Mr. Parker stated he has already talked to them and worked out a plan. They will need to move the entrance to the drive way down a hundred (100) feet. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Mike Folmar, seconded by John Lee to approve the petition. Motion carried 5 -0. 5. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Paris Lakes Medical Center LLC Addition 346, located at 2675 SE 41" Street. Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by Billy Trenado, seconded by John Lee to approve the preliminary plat, subject to the City Engineer's recommendations. Motion carried 5 -0. 6 Consideration of and action on the Final Plat of Lot 1, Block A, Paris Lakes Medical Center LLC Addition 346, located at 2675 SE 41" Street. Shawn Napier reviewed the final plat with commissioners. Motion was made by John Lee, seconded by Barney Bray to approve the final plat, subject to the City Engineer's recommendations. Motion carried 5 -0. 7. Discussion and possible action regarding the creation of a new use for a flea market and considering appropriate zoning district(s). Shawn Napier, City Engineer presented the request from Mr. Allen Hughes for the creation of a new use for a flea market and considering the appropriate zoning district(s). Mr. Napier stated that Mr. Hughes is in the process of purchasing the old Oliver Rubber and Superior Switchboard properties located on N.W. Loop 286. Mr. Hughes would like to clean up the properties and create a flea market similar to Canton, Texas or Traders Village. Mr. Hughes submitted two letters stating that he would like to have a flea market, auction house, private party rental /open building, benefit fund raisers, car shows, light manufacturing, paid parking, restaurant, private club & steakhouse, and storage building/warehouse at this location. Mr. Napier stated that staff has reviewed the possible uses and matched some of them with already listed uses. The first two are not listed. One of the listed uses in the zoning ordinance is "fairground or Exhibition Area" which could encompass the private party rental /open building and car shows. The other items are listed in the zoning ordinance. The common denominator to these items is Light Industrial (LI) and Planned Development (PD). Staff recommends that a new use be created in the zoning ordinance for a Flea Market that would be allowed in a Light Industrial District (LI) with a Specific Use Permit (SUP) or in a Planned Development District (PD). This would give City Staff, Planning and Zoning Commission and City Council more control over what was allowed or not allowed in the zoning district. Staff does not recommend allowing vehicle or large equipment auctions under this proposed use. Dr. Jerry Akers asked it this wouldn't be like the flea market we have now. Mr. Napier stated we have placed a definition for a flea market, it would be defined as an outdoor or covered market at a location at which booths or similar spaces are rented or otherwise made temporarily available to two or more people and at which the persons offer tangible personal property for sale. Outdoor auctions are not permitted under this use. Mr. Hughes stated he is planning on cleaning the Oliver Rubber property up and starting with an open area flea market. The plan is to build a new structure on the Oliver Rubber property and make this flea market have a nice clean atmosphere. The Superior Switchboard property is mainly going to be parking due to the access off the loop. The Planning and Zoning Commission had concerns about the traffic flow on the loop. Mr. Hughes stated that he picked this location for the access point off the loop and the cross over, plus he would have access off of 19th Street if needed. Billy Trenado asked if he is planning on using the existing buildings at these locations. Mr. Hughes stated both structures need a new roof and the switchboard property the office space is the only thing that can be used right now due to equipment that needs to be removed. Mr. Hughes stated he has been looking for a location to do something like this for several years and he believes this would be a wonderful location for a flea market. Motion was made by Barney Bray, seconded by John Lee to create a Flea Market use that will be allowed in Planned Development (PD) zoning and Light Industrial (LI) zoning with a Specific Use Permit (SUP). Motion carried 5 -0. 8. Discussion and possible direction to the city staff regarding the mobile home /manufactured home zoning ordinance. Shawn Napier, City Engineer stated the current zoning ordinance allows mobile homes to be placed in a One - Family Dwelling District (SF -3) with a Specific Use Permit (SUP). It allows a Modular Home to be placed in almost every zoning district except the two industrial zoning, Public Lands & Institutions (PLI) and Expressway Service Station (ESS). It also includes a Mobile Home Subdivision that is allowed in One - Family Dwelling Districts (SF -3) and a Mobile Home Park that is allowed in Light Industrial (LI) zoning. The difference between a Mobile Home Park and a Mobile Home Subdivision is the lot. A Mobile Home Park is a single lot with one owner and a Mobile Home Subdivision consist of multiple lots similar to a single family subdivision. Joey Sleeper, Building Official stated the term we use for a mobile home is an archaic term; mobile homes have not been legal since 1976. The current ordinance does not follow the definitions set out in federal and state law for mobile home and modular home. One option to correcting this problem would be to delete the two listings of Modular Home and Mobile Home. Change the word Mobile in Mobile Home Park and Mobile Home Subdivision to HUD -code manufactured. Also, only allow a HUD -code manufactured Park or Subdivision in Light Industrial (LI) zoning with a SUP. Delete Specific Use Permit #39 (Mobile Home). This would only allow HUD -code manufactured homes in these two uses and not allow a single mobile home to be place in any zoning district. The current Future Land Use Plan (FLUP) has designated three areas for Manufactured Housing. The Planning and Zoning Commission has concerns regarding the appearance, cleanliness and location of the manufactured homes. 9.
