04/20/2015 MINUTESMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, APRIL 20, 2015 3:00 P.M. 1. Johnny Norris called the Building and Standards Commission Meeting to order at 3:00 P.M. Roll was called. A. The following members were present: Matthew Allen Sally McEwin Chad Lindsey Johnny Norris Wendell Moore Ben Vaughan B. Staff present: Robert Talley Nicki Brown Dale Maberry Stephanie Harris Larry Wright C. Others present: Naomi F Bates — property owner Richard Bates — property owner son Sharon Pendergraft — property owner 2. Approval of minutes from previous meetings. (March 16, 2015) Motion was made by Sally McEwin and seconded by Wendell Moore to approve the minutes for March 16, 2015 meeting. Motion carried unanimously. 6 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and/or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": Request made by Robert Talley to skip to 3. D. — 303 SE 6th 3. D. 303 SE 6t'', City of Paris, Block 115, Lot 1 & 1 -A Owner: Charles D & Naomi F Bates 317 SE 6u' Paris, TX 75460 Back Taxes Owed: $0 Naomi F Bates and Richard Bates her son were present. Robert Talley stated that the structure needs to be repaired. It has missing windows, unsecure and the front porch has missing lumber. Robert Talley's recommendation: 90 days to repair and if not the structure will come back to the Commission. Naomi Bates stated that she is looking for someone to fix the porch and that the windows have been bought they just haven't been put in yet. Chad Lindsey asked if the structure is leaning and Robert Talley stated that he thinks it appear to be leaning due to the way the siding is put on the house. Johnny Norris asked if the roof leaks and Richard Bates stated that the porch does due to trees falling on it during the storms. Mr. Bates stated that the insurance company hasn't made it to look at the roof yet but they have been contacted. He explained that the renters did a lot of damage to the property. The property is vacant now and has been for about 1 month but due to the rain the repairs are going slow. Mr. Bates stated the floor is structurally sound the roof just needs new framing and roofing. Mr. Vaughan discussed roofing materials with Mr. Bates. Motion was made by Ben Vaughan, seconded by Wendell Moore to accept Robert Talley's recommendation. FM 79 A175, T G Chisum Survey, Tract 12 Owner: Stacy & Sheila Pendergraft Rt. 1 Box 105 Paris, TX 75460 Back Taxes Owed: $0 Sharon Pendergraft 3790 FM 79 Sumner, TX 75486 was present. Robert Talley stated that the structure has humps and waves in the roof, plywood is dipping, the roof is separating, tarps are on the back of the roof, they used political signs to patch the house, the back porch is collapsing, the structure is sinking, unsecure and has deteriorating and missing wood and is leaning. Sharon Pendergraft stated the structure has been vacant for 2 years. The property has been subjected to vandals and a tree fell on it. She wants to empty the lot. Johnny Norris asked what time frame she was looking at. Mrs. Pendergraft said due to her husband having three heart attacks she needed 90 days. Chad Lindsey asked if the structure was secure. Robert stated yes. Ben Vaughan asked if the man Mrs. Pendergraft was hiring to demolish the house was in the demo business. She said he advertises to be in the business. Chad Lindsey asked if the structure has utilities and Mrs. Pendergraft stated the structure has water and lights. The L.P. gas is turned off. Robert Talley's recommendation: 90 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. I. — FM 79 A175 Track 12 A I. FM 79 A175 TG Chisum Survey, Tract 12 -A Owner: Stacy & Sheila Pendergraft Rt. 1 Box 105 Paris, TX 75486 Back Taxes Owed: $0 Sharon Pendergraft 3790 FM 79 Sumner, TX 75486 was present. Robert Talley stated that the structure is a trailer house. The siding is coming off, insulation and tubing are coming out of the bottom of the trailer, its unsecure and the roof is raised. Also there is a shed behind the trailer that is only standing because a tree is holding it up. Mrs. Pendergraft stated of the trailer house is in immaculate shape. The black on the roof that's running off is where her son tarred the roof and it ran down the structure. She stated the ice storm is what hurt the shed and that her grandson is going to take the shed down this coming week. The doors of the trailer house are slipping and the trailer house is sitting on concrete blocks. She stated that she doesn't know how to take the trailer house down. Robert Talley stated that is will have to be disassembled, bull dozed or removed. Mrs. Pendergraft stated that she wants the property cleared. She asked for 90 days to repair, demolish or removed the trailer house. Robert Talley's recommendation: Shed - 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Trailer House — repair or remove in 90 days if not the trailer house will come back to this commission. Motion was made by Wendell Moore, seconded by Chad Lindsey to accept Robert Talley's recommendation. Motion carried unanimously. 6 -0 A. 42 NW 25th, Wortham & Carlton Addition, Block 3, Lot 1 Owner: Jack Stell 911 Montview Dr. Katy, TX 77450 -2809 Back Taxes Owed: $0 Mr. Stell contacted Robert Talley and asked for 90 days to repair. Robert Talley stated that he has spoken to the owner and they asked to have 90 days to repair the structure. It's unsecure, has fire damage and broken windows. Robert Talley's recommendation: 90 days to repair the structure and 10 days to secure the structure. If the work is not done the structure will come back to the commission. Motion was made by Chad Lindsey, seconded by Wendell Moore to accept Robert Talley's recommendation. Motion carried unanimously. 6 -0 B. 115 W Neagle, Subdivision of Block 170 -B, Block B, Lot 11 -12 Owner: Linda Sims C/O Carolyn Hayden PO Box 941002 Plano, TX 75094 Back Taxes Owed: $9608.57 Robert Talley has had no contact with owners. Robert Talley stated that the siding is falling off, the roof is sagging, the foundation has damage, structure is sinking, unsecure, missing windows and it is rotting. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Johnny Norris, seconded by Sally McEwin to accept Robert Talley's recommendation. Motion carried unanimously. 6 -0 C. 1201 E Grove, City of Paris, Block 175 -A, Lot 3 Owner: John G Josepho Trustee of John Josepho Living Trust 300 Carlsbad Village Dr. Suite 108A -389 Carlsbad, CA 92008 Back Taxes Owed: $470.90 Robert Talley stated that after the March meeting where a ruling of 30 days to demolish was ordered Mr. Josepho contacted him. He asked that he have 90 days to repair. Robert explained that if they issue a new order it will override the current order. Robert said that the structure is in the dry, boarded up and completely secure. Stephanie Harris (Assistant City Attorney) stated that if the commission thinks any structure can be reasonably repaired they have to issue a repair order. Robert Talley's recommendation: repair within 90 days if not the structure will come back to the commission. Motion was made by Ben Vaughan, seconded by Wendell Moore to accept Robert Talley's recommendation. Motion carried unanimously. 6 -0 E. 558 Paris Blvd, Neagle Addition, Block 4, Lot Ctr 50' of 10 -11 -12 Owner: Mary J Tisdell & Victor A Bringle 994 Amherst Paris, TX 75462 Back Taxes Owed: $0 The item was pulled from the agenda. Owner signed right of entry and indemnification. F. 610 SW 6`b, City of Paris, Block 151, Lot 4 -A Owner: Wheeler Properties Paris LLC 200 CR 1451 Bonham, TX 75418 Back Taxes Owed: $0 Robert Talley stated he talked to Mr. Wheeler and that the structure had a fire and it's tied up in insurance right now. Robert Talley's recommendation: 10 days to secure the structure and if it's not secured the City will secure it. Motion was made by Ben Vaughan, seconded by Sally McEwin to accept Robert Talley's recommendation. Motion carried unanimously. 6 -0 G. 645 E Polk, Gibbons Park, Block 2, Lot 17 Owner: Geraldine Brackeen 3904 Buchanan Road Texarkana, TX 75501 Back Taxes Owed: $1832.91 Robert Talley spoke with Ms. Brackeen's granddaughter and Ms. Brackeen lived in Clarksville but has moved to Texarkana and is staying with the granddaughter due to health problems. They asked for 90 days to come up with a plan because Ms. Brackeen's accounts are frozen due to fraud. The Brackeen's agree the structure needs to be demo'ed. Robert Talley stated that the structure is leaning, siding is falling off, it has deteriorating and rotting wood, ceiling tiles inside are falling, it's leaking inside, unsecure, windows are broke, under pinning is popping off, it's sinking and the roof is sagging. Robert Talley's recommendation: 90 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. 10 days to secure the structure of the City of Paris will secure it. Motion was made by Wendell Moore, seconded by Chad Lindsey to accept Robert Talley's recommendation. Motion carried unanimously. 6 -0 4. Code Enforcement Update Nine properties were brought before the Commission in March 2015. Four structures were demolished in March 2015. The Commission wanted to know how much money was still in the demolition budget. Robert Talley stated that we are still operating but at the end of the $400,000 the City Council budgeted for demo. The Fire Chief Larry Wright stated that the City Manager instructed our department to continue going forward on our demo list. He also informed the council that the Kammer's lost their appeal on their structure on South Main. The cost is estimated at $400 -450 thousand to tear the structure down. This structure will sit for a while due to the cost. Robert Talley explained that the weather is slowing us down. 5. Future agenda items. 6.
