05/04/2015 MINUTESMINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION CITY COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, MAY 4, 2015 5:30 O'CLOCK P.M. The meeting of the Planning and Zoning Commission on Monday, May 4, 2015, was called to order at 5:3Op. m. by Holland Harper, Chairman. A. The following members were present: Jerry Akers, John Lee, Holland Harper, James Price and Mike Folmar B. The following members were absent: Barney Bray and Billy Trenado C. Also present were Shawn Napier, Director of Engineering; Joey Sleeper, Building Official; John Godwin, City Manager; Sue Lancaster, City Council; and Ashley Fendley, Secretary for the Planning and Zoning Commission. 2. Approval of minutes from previous meetings. (April 6, 2015) Motion was made by James Price, seconded by John Lee to approve minutes for the April 6, 2015 meeting. Motion carried 5 -0. Motion was made by Holland Harper, seconded by John Lee to move item number six up on the agenda. Motion carried 5 -0. 6. Public hearing and consideration of and action on the petition of Chris Methvin for a change in zoning from a General Retail District (GR) to a Commercial District (C) on Lot 25 & 26, Block 281, Johnson Woods Est. located at 3015 Clarksville Street. Public hearing was declared open. A. No one spoke in favor of the petition. B. Six individuals spoke in opposition. Don Haslam, 3140 Clark Lane Paris, Texas, Holland Harper read his letter so that it would be on record in opposition of the petition. Mr. Haslam has concerns about the increased likelihood of pedestrian/vehicle accidents involving residents of the area and children/students. Ed Pitts, 650 Twin Oaks Place Paris, Texas, Shawn Napier read his letter so that it would be on record in opposition of the petition. Mr. Pitts has concerns that the amount of foot traffic in the area between residents, Crocket school, children and potential buyers will create a hazardous and unsafe situation. Gary and Becky Nash, 645 Johnson Woods Drive Paris, Texas, Benjamin Alsup read their letter so that it would be on record in opposition of the petition. Mr. and Mrs. Nash had concerns that this type of business would decrease the market value on the neighborhood. Christopher Donnan, 615 Johnson Woods Drive Paris, Texas, spoke in opposition of the petition. Mr. Donnan stated that we have put a lot of money into the safe routes to school project and a used car lot in this location wouldn't be very safe. Don Wilson, 3110 Stacy Lane Paris, Texas, spoke in opposition of the petition. Mr. Wilson stated he has concerns about changing the zoning for future businesses that might come in that location. Walker Putnam, 495 Johnson Woods Drive Paris, Texas, spoke in opposition of the petition. Mr. Putnam stated he has concerns with the entrance to Johnson Woods from Clarksville Street and decrease in property values. Public hearing was declared closed. Motion was made by Holland Harper, seconded by John Lee to deny the petition. Motion carried 5 -0. 3. Public hearing and consideration of and action on the petition of Shabecka Wilson for a change in zoning from a One - Family Dwelling District No. 3 (SF -3) to One - Family Dwelling District No. 3 (SF -3) with a Specific Use Permit (39- Mobile Home) on Lot 22, City Block 297, being located at 1836 Butler Lane. Public hearing was declared open. A. Two individuals spoke in favor of the petition. Shabecka Wilson, 1836 Butler Lane Paris, Texas, spoke in favor of the petition. Mrs. Wilson stated she wants to bring in a new mobile home to replace the one she have now. Mrs. Wilson further stated she wishes the Planning and Zoning Commission would please approve this request. Melba Davidson, 2750 N.W. 19th Street Paris, Texas, spoke in favor of the petition. Ms. Davidson stated that she was for this item. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by John Lee, seconded by James Price to approve the petition. Motion carried 5 -0. 4. Public hearing and consideration of and action on the petition of Marx Offutt for a change in zoning from a Commercial District (C) to a Commercial District (C) with a Specific Use Permit (55 -Self Storage /Mini Warehouse) on Lot 1, City Block A, Offutt Properties, LLC Addition No. 2 CB 94, located at 805 North Main Street. Public hearing was declared open. A. One individual spoke in favor of the petition. Marx Offutt, 4808 CR 22880 Paris, Texas, spoke in favor of the petition. Mr. Offutt stated he wants to build enclosed boat storage units on the back side of this property. Mr. Offutt further stated most of the units will be for personal use, but he will also have some available to rent out. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Jerry Akers, seconded by John Lee to approve the petition. Motion carried 5 -0. 5. Public hearing and consideration of and action on the petition of E. Martin Blake for a change in zoning from a Commercial District (C) to a Commercial District (C) with a Specific Use Permit (55 -Self Storage /Mini Warehouse) on Lot 3C & 3D, City Block 281, located at 1640 & 1650 Clement Road. Public hearing was declared open. A. One individual spoke in favor of the petition. E. Martin Blake, 5604 FM 79 Paris, Texas, spoke in favor of the petition. Mr. Blake stated he wants to use part of their building to build climate control storage units. Mr. Blake further stated he is hoping the Planning and Zoning Commission will approve the petition. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by Mike Folmar, seconded by John Lee to approve the petition. Motion carried 5 -0. 7. Discussion and possible direction to the city staff regarding the mobile home /manufactured home zoning ordinance. Shawn Napier, City Engineer stated the Commission will be looking at Article I Definitions tonight May 4, 2015, Article III Mobile Home Parks in June, and Zoning Ordinance 8 -101 Schedule of Uses in July. Mr. Napier further stated that on the definitions attached the red letters are original portions of the ordinance that have been struck, the green letters added and the black letters are original to the document and not changed. The section of purple may need to be revised once we review the mobile home park section of the ordinance. Holland Harper stated we need to start thinking about the RV Parks. Mr. Napier stated we will include that with Article III Mobile Home Parks next month in June. The Planning and Zoning Commissioners were pleased with what the City Staff had provided for Article I Definitions. 8. Discuss and provide direction to staff on changing zoning from Commercial to General Retail on lots that front Lamar Ave. in the 3600 Block to the 4800 Block. Shawn Napier, City Engineer stated city staff has been tasked with bringing proposed zoning changes forward on Lamar Avenue outside the Loop. The primary change would be to change the zoning of the properties that front Lamar Avenue outside Loop 286 from the existing zoning to General Retail (GR). The existing zonings include Commercial (C), General Retail (GR), Agricultural (A), Planned Development (PD -a -b) and one duel -zoned Commercial (C) and Light Industrial (LI). Staff has reviewed the existing uses in this section of Lamar Avenue and only five existing uses would not be allowed in General Retail (GR) zoning. The five uses include a used car lot, two auto repairs, contractor's shop /storage yard and storage warehouse. These five uses would become non - conforming uses if the zoning is changed to General Retail (GR). Three billboards exists in this section that are currently non - conforming uses, if the zoning changed they would still be non - conforming uses. Staff would recommend doing a few of these at a time over several months starting with the vacant lots. The Planning and Zoning Commission discussed the matter at hand and want to move forward with the first twenty -three (23) properties on the south side of the loop that the zoning change is required. Mike Folmar asked after we complete this zoning request for Lamar Avenue will we move on to another area in the City of Paris. Shawn Napier stated that is always an option in moving forward with our zoning map. 9.
