12 - DISANNEXATION REQUESTSItem No. 12 memorandum TO: City Council John Godwin, City Manager FROM: Kent McIlyar, City Attorney SUBJECT: Disannexation Requests Airport Road and Wildwood Lane DATE: July 9, 2015 BACKGROUND: At the June City Council meeting, Boyd & Deborah Hudgens and several other residents with property inside the city limits near Airport Road and Hwy 271 came before the City Council and requested the Council to consider disannexing their properties from the City of Paris because they do not receive city water or sewer service in that area. Mr. Godwin informed the City Council that while these property owners do receive city services such as police, fire and EMS, but the City does not have immediate plans to run water or sewer lines down Airport Road, because there is already a Lamar County Water Supply District (LCWSD) water line serving the area and there is not enough population or development in the area yet to justify running long sewer lines and lift stations in the area. David Denison also appeared before City Council requesting that his five acre residential lot on Wildwood Lane be disannexed from the City. STATUS OF ISSUE: During the last four weeks, the City has received disannexation requests from the owners of approximately 27 tracts of property located inside the original 1228.89 acre Tract 12 Parcel from Annexation Ordinance 1997 -059 (North side of FM 1508 /Airport Road) and seven disannexation requests from property owners from Tract 8, Annexation Ordinance 1999 -034 (South side of FM 1508 /Airport Road). A map depicting the location of the parcels requesting disannexation is included in your City Council Member packet. The seven parcels south of FM 1508 /Airport Road (Tract 8) appear to meet the criteria for disannexation as set out in the City's Policies and Procedures for Annexation/Disannexation (adopted June 2014), as those parcels can be disannexed from the city limits without creating any holes or islands outside our corporate city limits. Two of the larger parcels in Tract 12 (north of FM 1508 /Airport Road) requesting disannexation, Devoss #10 and Mehmeti #28, do not comply with the City's Disannexation policies because to disannex them would force all property east of two tracts including the City Airport, the undeveloped airport property, Agpro Property and several other developed and undeveloped parcels not seeking disannexation outside the corporate city limits and break the City's contiguous boundary lines. The White Parcel, No. 31 on your map, also known as Part of Lots 18 & 19, Sunrise Strip Addition, is also a problem because the lots on each side of the White Parcel have not requested disannexation and this will create a hole in the city limits and will break up the City's contiguous city boundary line unless the City Council decides to include all lots adjoining the north side of Airport Road into the proposed disannexation ordinance. Lot 1, Block A Blalock addition, off Old Clarksville Road is not close to the other Airport Road disannexation requests and would create a hole in the corporate city limits and would create a break in our contiguous city limit boundary line, therefore it does not meet the requirements contained in the City's Annexation/Disannexation policies and should not be considered at this time. The owners of Lot 14 in the Wildwood Subdivision off Smallwood Road are also requesting disannexation, but to do so would push Lot 16 owned by Celeste Wilcox (who is not requesting disannexation) out on to an island outside the corporate city limits of the City of Paris and is therefore not recommended because it would not comply with city policy and would break up the City's contiguous boundary line. PROCESS: The process for disannexing properties from the City of Paris requires two public hearings over a 40 -day period preceded by a 30 -day written notice to all property owners being disannexed and notice to Lamar County, School Districts and Railroad Companies. Once the City Council directs staff which parcels are to be disannexed it will take approximately 90 days to completion. BUDGET: N/A RECOMMENDATION: Provide direction to staff.
