1. The meeting of the Planning and Zoning Commission on Monday, June 1, 2015, was called
to order at 5:31 p.m. by Holland Harper, Chairman.
A. The following members were present: Jerry Akers, John Lee, Holland Harper,
James Price, Barney Bray and Billy Trenado
B. The following members were absent: Mike Folmar
C. Also present were Shawn Napier, Director of Engineering; and Ashley Fendley,
Secretary for the Planning and Zoning Commission.
2. Approval of minutes from previous meetings. (May 4, 2015)
Motion was made by James Price, seconded by John Lee to approve minutes for the May 4,
2015 meeting. Motion carried 6 -0.
3. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Malone Village CB
325, located in the 2900 Block of Campbell Street.
Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by
James Price, seconded by Jerry Akers to approve the preliminary plat, subject to the City
Engineer's recommendations. Motion carried 6 -0.
4. Consideration of and action on the Final Plat of Lot 1, Block A, Malone Village CB 325,
located in the 2900 Block of Campbell Street.
Shawn Napier reviewed the final plat with commissioners. Motion was made by Jerry
Akers, seconded by Billy Trenado to approve the final plat, subject to the City Engineer's
recommendations. Motion carried 6 -0.
5. Public hearing and consideration of and action on a change in zoning from a Commercial
District (C) to a General Retail (GR) on the following:
a. Lot 2 -F of City Block 313, being located at 3680 Lamar Avenue (CVS)
b. Lot 1, Block A of Petco Plaza 313, located at 3920 Lamar Avenue ( Petco Plaza
shopping center)
c. Lot 2, Block A of Petco Plaza 313, located at 3922 Lamar Avenue (Taco Bell)
d. Lot part of 1, Block A of the Morningside North Addition, located at 3940 Lamar
Avenue (nail salon)
e. Lot 2, Block B of the Morningside North #2 Addition, located at 4250 Lamar

Public hearing was declared open.
A. One individual spoke in favor of the petition.
Carolyn Patterson, 4025 Alpine Paris, Texas, spoke in favor of the petition. Mrs.
Patterson stated that she owns the home at 4225 Primrose, which backups to the
Cave Wave and the Glick's property. Mrs. Patterson stated she believes that Lamar
Avenue should be a General Retail (GR) area instead of Commercial (C) area.
B. Two individuals spoke in opposition.
Richard Weemes, 625 S.E. 42nd Street Paris, Texas, spoke in opposition of the
petition. Mr. Weemes stated when he built Reno Paint and Body he had the zoning
changed to Commercial (C), which is appropriate to operate his business in. Mr.
Weemes concerns are if the city changes his zoning to General Retail (GR) he will
become a non - conforming use and will be unable to expand or sale his business.
Mr. Weemes further stated he wishes the commission will deny this petition.
Brady Fisher, 3870 Lamar Avenue Paris, Texas, spoke in opposition of the petition.
Mr. Fisher stated he is the only house left on Lamar Avenue in this location and he
wants to keep his zoning of Agricultural (A). Mr. Fisher further stated he hopes the
board won't change his zoning.
C. One individual spoke neither for nor against.
Jason Cooper, representing the CEFCO Food Fast, spoke neither for nor against the
petition. Mr. Cooper asked if this zoning change was for their back property also.
Shawn Napier stated that this would just affect the property at 3750 Lamar Avenue.
Public hearing was declared closed.
The Planning and Zoning Commission had several concerns on how this zoning change
would affect the businesses. The Planning and Zoning Commission believes that the
citizens that own the businesses should be able to request their own zoning change if they
would like to. Motion was made by Barney Bray, seconded by John Lee to deny the
petition. Motion carried 6 -0.
6. Public hearing and consideration of and action on a change in zoning from a Commercial
District (C) to a General Retail (GR) with a Specific Use Permit (49 -Auto fuel sales in GR
District) on Lot 1, Block A of the CEFCO #1097 Addition, located at 3750 Lamar
Avenue ( CEFCO gas station)
Public hearing was declared open.
A. No one spoke in favor of the petition.
B. No one spoke in opposition.
Public hearing was declared closed.
Motion was made by Billy Trenado, seconded by James Price to deny the petition. Motion
carried 6 -0.
Motion was made by Jerry Akers, seconded by John Lee to recuse Holland Harper. Motion
carried 5 -0.
7. Public hearing and consideration of and action on a change in zoning from a Commercial
(C) and Light Industrial (LI) District to a General Retail (GR) District on the following:
a. Lot part of 3 in City Block 313, located in the 3700 Block of Lamar Avenue and
being 1.404 acres (Lamar Access Road LLC)
b. Lot 3, Block A of the R S Enterprises Addition, located at 3820 Lamar Avenue
(Chicken Express)
Public hearing was declared open.
A. No one spoke in favor of the petition.
B. One individual spoke in opposition.
Holland Harper, 1040 S.E. 41St Street Paris, Texas, spoke in opposition of petition.
Mr. Harper stated the Lamar Access Road is a piece of property to 11.97 acres with
a 77,000 square foot former manufacturing plant that is now used for a warehouse.
It has over 5,000 amps of power, sprinkled, and is currently being used as a
warehouse. This property is broken up into two lots, one is the road and the other is
the rest of the property. Mr. Harper further stated you can't operate a warehouse in
a General Retail (GR) zoning district, this zoning change will hurt the property.
Public hearing was declared closed.
Motion was made by Barney Bray, seconded by John Lee to deny the petition. Motion
carried 5 -0.
Motion was made by Billy Trenado, seconded by John Lee for Holland Harper to return to
the meeting. Motion carried 5 -0.
Holland Harper suggested combining this rest of the agenda. Motion was made by John
Lee, seconded by Billy Trenado to combine items 8 through 12. Motion carried 6 -0.
8. Public hearing and consideration of and action on a change in zoning from a Commercial
(C) and Light Industrial (LI) District to a General Retail (GR) District with a Specific Use
Permit (3 -Auto laundry in GR District) on Lot 1 and 4, Block A of the R S Enterprises
Addition, located at 3782 Lamar Avenue (car wash)
9. Public hearing and consideration of and action on a change in zoning from a Commercial
(C) and Light Industrial (LI) District to a General Retail (GR) District with a Specific Use
Permit (48- Gasoline service station in GR District) on Lot part of 2, Block A of the R S
Enterprises Addition, located at 3800 Lamar Avenue (Pennzoil)
10. Public hearing and consideration of and action on a change in zoning from an Agricultural
(A) District to a General Retail (GR) on Lot 7, City Block 313 of the Leach Survey
Abstract 524, located at 3870 Lamar Avenue (Brady Fisher — single family residence)
11. Public hearing and consideration of and action on a change in zoning from a Commercial
District (C) to a General Retail (GR) with two Specific Use Permits (3 -Auto laundry in GR
District and 49 -Auto fuel sales in GR District) on Lot 3, Block A of the Morningside North
Addition, located at 4120 Lamar Avenue (Family Mart gas station and Family Mart car
wash)
12. Public hearing and consideration of and action on a a change in zoning from a Commercial
District (C) to a General Retail (GR) with a Specific Use Permit (3 -Auto laundry in GR
District) on Lot 1, Block B of the Morningside North #2 Addition, located at 4210 Lamar
Avenue (Cave Wave car wash)
Public hearing was declared open.
C. No one spoke in favor of the petition.

Public hearing was declared closed.
Motion was made by James Price, seconded by Billy Trenado to deny the petitions. Motion
carried 6 -0.
