07/06/2015 MINUTESMINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION CITY COUNCIL CHAMBERS 107 E. KAUFMAN STREET PARIS, TEXAS MONDAY, JULY 6, 2015 5:30 O'CLOCK P.M. The meeting of the Planning and Zoning Commission on Monday, July 6, 2015, was called to order at 5:3 Op.m. by Holland Harper, Chairman. A. The following members were present: Holland Harper, John Lee, Jerry Akers, Barney Bray and Robert Spain R The following members were absent: Billy Trenado and Mike Folmar C. Also present were Shawn Napier, Director of Engineering, Planning and Development; Dr. Steve Clifford, City Council and Ashley Fendley, Secretary for the Planning and Zoning Commission. 2. Election of Officers: A. Chairman — Motion was made by John Lee, seconded by Barney Bray to nominate Holland Harper as Chairman. Motion carried 5 -0. B. Vice - Chairman — Motion was made by Jerry Akers, seconded by Barney Bray to nominate John Lee as Vice - Chairman. Motion was made by John Lee, seconded by Robert Spain to nominate Jerry Akers as Vice - Chairman. Chairman Holland Harper called for a vote on the nomination of John Lee. Motion was denied 2 -3, with John Lee, Holland Harper and Robert Spain casting the dissenting vote. Chairman Holland Harper called for a vote on the nomination of Jerry Akers. Motion carried 3 -2, with Jerry Akers and Barney Bray casting the dissenting vote. C. Secretary — Motion was made by Holland Harper, seconded by John Lee to nominate Barney Bray as secretary. Motion carried 5 -0. 3. Approval of minutes from previous meetings. (June 1, 2015) The Planning and Zoning Commission discussed bringing back the Lamar Avenue zoning changes from the June 1, 2015 meeting. No motion was made. Motion was made by Jerry Akers, seconded by John Lee to approve minutes for the June 1, 2015 meeting. Motion carried 5 -0. 4. Public hearing to consider the petition of the City of Paris for a change in zoning from a Public Lands and Institution District (PLI) to Two - Family Dwelling District (2F) with a Specific Use Permit (9- Institutions of Religious or Philanthropic Nature) on Lot 9, City Block 151, being located at 616 West Washington Street. Public hearing was declared open. A. No one spoke in favor. B. No one spoke in opposition. Public hearing was declared closed. Motion was made by John Lee, seconded by Barney Bray to approve the petition. Motion carried 5 -0. 5. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Farris 167-A Addition, located in the 400 Block of S.E. Loop 286 Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by John Lee, seconded by Jerry Akers to approve the preliminary plat, subject to the City Engineer's recommendations. Motion carried 5 -0. 6 Consideration of and action on the Final Plat of Lot 1, Block A, Farris 167 -A Addition, located in the 400 Block of S.E. Loop 286 Shawn Napier reviewed the final plat with commissioners. Motion was made by John Lee, seconded by Barney Bray to approve the final plat, subject to the City Engineer's recommendations. Motion carried 5 -0. 7. Discussion and possible action regarding the creation of a new use for tattoo parlor /shop and body piercing shop and considering the appropriate zoning district(s). Shawn Napier stated the current zoning ordinance does not contain a listed use for tattoo shops or body piercing shops. Mr. Napier stated staff has reviewed the possible uses and recommends that tattoo and body piercing shops be added under the definition for Custom Personal Service Shop (Zoning Ordinance section 8 -106 Retail & Service Type Uses #24). The current listed uses under this category include: tailor, shoe repair, barber, beauty shop, health studio and travel consultant. Mr. Napier further stated Custom Personal Service Shops are currently allowed in Neighborhood Service (NS), General Retail (GR), Commercial (C), Central Area (CA), Light Industrial (LI), Heavy Industrial (HI) and Planned Development (PD). The Planning and Zoning Commission had a few concerns about allowing a tattoo and body piercing shop in Neighborhood Service (NS). Shawn Napier stated we can create a completely new use to the zoning chart instead of adding it to the Custom Personal Service Shops. Motion was made by Holland Harper, seconded by John Lee to allow tattoo and body piercing shops by right in Commercial (C), Light Industrial (LI) and Heavy Industrial (HI) Zoning Districts and with a specific use permit in General Retail (GR), Central Area (CA) and Planned Development (PD) Zoning Districts. Motion carried 5 -0. 8. Meeting adjourned at 6:36 p.m. APPROVED THIS 3RD DAY OF AUGUST, 2015
