SUBJECT: ZONING CHANGES FROM A LIGHT INDUSTRIAL DISTRICT (LI) TO A
PUBLIC LANDS AND INSTITUTION DISTRICT LOCATED AT 2310 AND 2320 N.W.
19TH STREET.

BACKGROUND: This application is for a public hearing to consider the petition the City of
Paris for a change in zoning from a Light Industrial District (LI) to a Public Lands and Institution
District (PLI) on Lot part of 12 and part of 13, City Block 297, being located at 2310 and 2320
N.W. 19th Street.
STATUS OF ISSUE: The City staff has determined the following findings:
(A) Existing Land Use: This property fronts on N.W. 19th Street and is comprised of 0.571
acres, and there are no buildings or structures on these premises. The property has a substantial
amount of existing trees and there is no floodplain on this site. Existing single - family homes are
located adjacent on both the north and south sides of this subject property. To the east, south,
and southeast of this subject property are business uses which includes a large area devoted for
vehicle parking. Across 19a` Street and to the west, northwest, and southwest of the subject
property is located the Union Hall building; it includes the facilities of United Food and
Commercial Workers Union Local 540; the Employees United Federal Credit Union; the Paris
Police Officers Association; Local 176.
(B) Existing Zoning of the Subject Property: The property is currently zoned Light Industrial
District (LI).
(C) Proposed Land Use: This proposed use is for a City of Paris operated EMS facility. This
structure will provide for an EMS dispatch crew; crew sleeping quarters, and parking for EMS
and personal vehicles. There would be minimal noise level from this EMS use. This subject site
provides excellent emergency access to Loop 286 and the proximity of N.W. 19th Street offers
ready access to other parts of Paris.
(D) Proposed Zoning of the Subject Property The proposed zoning for this property is the
Public Lands and Institution District (PLI). The purpose of this zone is to primarily provide a
zoning district for land uses that are mainly publicly oriented; in particular, this EMS proposed
use can be found in the Zoning Ordinance in Sec. 8 -102 "Special Uses" under the category of
"Schedule of Uses ", namely: "Public Owned Buildings and Lands." Therefore, since this will
be a city -owned building, this PLI district is the appropriate zoning.
Further, while the existing zoning is Light Industrial, it can be observed from reviewing the
Zoning Ordinance, that there are a number of permitted uses in the Light Industrial district that
would be more intensive in character than this proposed EMS use.
(E) The Master Thoroughfare Plan (MTP) within the Comprehensive Plan:
For this subject property, the MTP recommends that N.W. 19th Street be classified as an Arterial
Roadway; the current R.O.W. on N.W. 19th fronting this site 40 feet. In this area 19th street
"dead ends" into the back of Lake Crook.
(F) Parks Recreation, and Open Space Master Plan: The following are the key graphics in this
park master plan: (1) Existing Parks and Open Space; (2) Trail and Sidewalk map; and (3)
Future Parks and Open Spaces; none of these plan maps are impacted by this EMS proposal.
(G) The Future Land Use Plan (FLUP) within the Comprehensive Plan:
The FLUP recommends Light Industrial on a portion of the eastern side of this subject property;
the remainder of the property recommended for Low Density Residential (LDR) use, as is the
property across N.W. 19a' street in this area. Typically, and in terms of land use compatibility,
low- density residential uses are not recommended adjacent to light industrial uses. The
Comprehensive Plan describes LDR use as "... representative of traditional, single - family
detached dwelling units ... The areas designated for low density residential land use are
generally not adjacent to major thoroughfares or compatible land uses, and are in proximity to
existing single - family residential land use." The subject envisions is currently represented by
scattered single- family dwellings.
In regard to the sparsely located existing single - family units; the existing industrial and
commercial character of the subject area; the functional location of this site for efficient EMS
service /emergency delivery; the additional opportunity for EMS services to be closer to city
residences, businesses and services; the fact that this EMS facility is determined to be less land
use intrusive and inoffensive than some of the permitted light industrial uses currently available
on this property by virtue of the existing Light Industrial Zoning Districts; and therefore this
EMS use is compatible with the LI zoning district; the city staff recommends approval of this
EMS proposed use.
RECOMMENDATION: The City Council approve this EMS facility and a zoning change from
a Light Industrial District to a Public Lands and Institution Zoning district.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS,
TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE LOT PART OF 12
AND PART OF 13, CITY BLOCK 297, BEING LOCATED AT 2310 AND 2320
N.W. 19TH STREET, IN THE CITY OF PARIS, LAMAR COUNTY, TEXAS,
FROM A LIGHT INDUSTRIAL DISTRICT (LI) TO A PUBLIC LANDS AND
INSTITUTIONS DISTRICT (PLI); DIRECTING A CHANGE ACCORDINGLY IN
THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER
CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission received a request for an
amendment to the Zoning Ordinance of the City of Paris to rezone Lot Part of 12 and Part of
13, City Block 297, located at 2310 and 2320 N.W. 19th Street, City of Paris, Lamar County,
Texas, from a Light Industrial District (LI) to a Public Lands and Institutions District (PLI);
and,
WHEREAS, on October 5, 2015, following notice and publication as required by law,
the Planning and Zoning Commission conducted a public hearing on the proposed
amendment to the City Zoning Ordinance and, following said hearing, made formal
recommendation to the City Council to approve the requested zoning; and,
WHEREAS, on October 12, 2015, following notice and publication as required by
law, the City Council of the City of Paris conducted a public hearing on the proposed
amendment to the City Zoning Ordinance, and having considered the recommendations of
the Planning and Zoning Commission and the testimony and evidence introduced at said
public hearing, found and determined that approving the aforesaid zoning change would be
consistent with the Comprehensive Future Land Use Plan of the City of Paris, consistent
with the City Zoning Ordinance, and in the best interests of the public health, safety, and
welfare of the citizens of the City of Paris by a vote of ayes and nays.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in
all things approved.
Section 2. That the Official Zoning Map of the City of Paris, Texas and Zoning
Ordinance No. 1710 of the City of Paris as heretofore amended is hereby further amended
to rezone Lot Part of 12 and Part of 13, City Block 297, located at 2310 and 2320 N.W. 19th
Street, City of Paris, Lamar County, Texas, from a Light Industrial District (LI) to a Public
Lands and Institutions District (PLI); and,
Section 3. That the Chief Building Official of the City of Paris be, and he is hereby,
directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes
set forth in this ordinance.
Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 5. That it is the intention of the City Council of the City of Paris that this
ordinance and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 6. That any person violating any provision of this ordinance shall be guilty of a
Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of
Sec. 1 -6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's
continuance of any violation of the above - enumerated sections shall constitute and be deemed
a separate offense.
PASSED AND ADOPTED on by the City Council of the City of Paris, in regular
session on this the 12th day of October, 2015.
