SUBJECT: SITE PLAN AT 3215 & 3225 LAMAR AVENUE
DATE: October 6, 2015
BACKGROUND: Both the owner of this subject property is Klement Investment in Gainesville,
Texas. They are requesting a public hearing to consider and take action regarding a Site Plan for
Richard Klement & Reginald Klement on Lots 8 & 9 of City Block 296, located at 3215 & 3225
Lamar Avenue. The Planning & Zoning Commission voted unanimously to recommend to the
City Council approval of this site plan request on October 5, 2015.
STATUS OF ISSUE: The city staff has determined the following:
(A) Existing Land Use: The subject property is currently vacant.
(B) Existing Zoning of the Subject Property: This property is currently zoned Planned
Development District (PD -a):
(C) Proposed Land Use: The proposed land use is for a small retail shopping center
consisting of approximately six spaces.
(D) Proposed Zoning of the subject propert y There is no zoning change request. The
existing zoning permits this retail shopping center. The site plan complies with the
City of Paris subdivision regulations.
BUDGET: N/A
RECOMMENDATION: Approve the site plan.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPROVING A SITE PLAN FOR RETAIL SHOPPING CENTER IN A PLANNED
DEVELOPMENT DISTRICT ON LOTS 8 & 9, CITY BLOCK 296, BEING
LOCATED AT 3215 & 3225 LAMAR AVENUE, PARIS, TEXAS; MAKING
OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT;
PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS
CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, previously the City Council of the City of Paris, approved an Ordinance
establishing a Planned Development District (PD -a: retail shopping center) for property
described as Lots 8 & 9, City Block 296, being located at 3215 & 3225 Lamar Avenue, Paris,
Texas.
WHEREAS, Klement Investment has filed a Site Plan with the City Engineer to
construct a Retail Shopping Center on the Property; and,
WHEREAS, the Site Plan was submitted and heard at a Public Hearing before the
City's Planning and Zoning Commission and on October 5, 2015 was approved by the
Commissioners; and,
WHEREAS, on October 12, 2015, Klement Investment's site plan was submitted and
heard at a Public Hearing before the City Council for consideration and the City Council
approved said Site Plan; and,
WHEREAS, pursuant to the City of Paris' Zoning Ordinance regulations, the Site Plan
was presented to the City Council for their review and consideration and was approved.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby
in all things approved.
Section 2. That the Site Plan, for Lots 8 & 9, City Block 296, being located at 3215
& 3225 Lamar Avenue, is hereby, approved.
Section 3. That all provisions of the ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other provisions
of the ordinances of the City of Paris not in conflict with the provisions of this ordinance
shall remain in full force and effect.
Section 4. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any
penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 5. That it is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 6. That any person violating any provision of this ordinance shall be
guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with
provisions of Sec. 1 -6 of Chapter One of the City of Paris Code of Ordinances, and each and
every day's continuance of any violation of the above - enumerated sections shall constitute
and be deemed a separate offense.
PASSED AND ADOPTED on by the City Council of the City of Paris, in regular
session on this the 12th day of October, 2015.
