The meeting of the Planning and Zoning Commission on Monday, August 3, 2015, was
called to order at 5:30 p.m. by Holland Harper, Chairman.
A. The following members were present: Holland Harper, John Lee, Jerry Akers,
Barney Bray, Billy Trenado, Mike Folmar and Robert Spain
B. Also present were Shawn Napier, Director of Engineering, Planning and
Development; Dr. Steve Clifford, City Council and Ashley Fendley, Secretary for
the Planning and Zoning Commission.
2. Approval of minutes from previous meetings. (July 6, 2015)
Motion was made by John Lee, seconded by Barney Bray to approve minutes for the July
6, 2015 meeting. Motion carried 7 -0.
Motion was made by Holland Harper, seconded by Mike Folmar to combine items 4
through 6; due to the fact the applicant is not the owner of the property located in the 2500
Block of Lamar Avenue. Motion carried 7 -0.
3. Public hearing to consider the petition of John House for a change in zoning from a
Planned Development District (PD -b) which is a housing development or community unit
development in the Planned Development Zoning District to Commercial District (C) on
Lots 6 and 7, City Block 331, being located at 3700 Block off. W. Loop 286
Public hearing was declared open.
A. One individual spoke in favor.
John House, 1446 Clarksville Street Paris, Texas, spoke in favor of the petition. Mr.
House stated he wishes to construct cabins for rental purposes on the southern half
of the property and a restaurant with a recreational area on the northern half.
B. No one spoke in opposition.
Public hearing was declared closed.
Motion was made by John Lee, seconded by Billy trenado to recuse Barney Bray. Motion
carried 6 -0.
Motion was made by Billy Trenado, seconded by John Lee to approve the petition.
Motion carried 6 -0.
Motion was made by Mike Folmar, seconded by Jerry Akers for Barney Bray to return to
the meeting. Motion carried 6 -0.
A motion was made earlier to combine items 4 through 6.
4. Public hearing to consider the petition of Skyler Burchinal for a change in zoning from a
General Retail District (GR) and Single Family Dwelling District No. 2 (SF -2) to
Commercial District (C) with a Specific Use Permit (55 -Self Storage /Mini Warehouse) on
Lot 7, part of 8 and 9, City Block 249, being located in the 2500 Block of Lamar Avenue.
Public hearing was declared open.
Shawn Napier, City Engineer stated that after Mr. Burchinal submitted his zoning change
and plats for the subject property it was discovered that ATMOS has an easement on the
property that would limit what Mr. Burchinal could build. Mr. Napier further stated that
Mr. Burchinal has not purchased the property and this application that has been submitted
to the City of Paris list Mr. Burchinal as the property owner. This application cannot be
legally approved
A. No one spoke in favor.
B. One individual spoke in opposition.
Donie Hussey, 3231 Hubbard Street Paris, Texas, spoke in opposition of the
petition. Mrs. Hussey stated that her property is to the east of this subjected
property and she believes that constructing storage units is not the best use for this
land. Mrs. Hussey further stated that she has concerns about the property value,
security issues, traffic flow and drainage issues.
Public hearing was declared closed.
5. Consideration of and action on the Preliminary Plat of Lot 1, Block A, Sky Park Addition
CB 249, located in the 2500 Block of Lamar Avenue.
6 Consideration ofand action on the Final Plat of Lot 1, Block A, Sky Park Addition CB 249,
located in the 2500 Block of Lamar Avenue.
Motion was made by John Lee, seconded by Barney Bray to deny the zoning change,
preliminary plat and the final plat for Skylar Burchinal located in the 2500 Block of Lamar
Avenue, subject to the City Engineer's recommendations. Motion carried 7 -0.
7. Consideration of and action on the Preliminary Plat of Lot 1, Block A, MK Properties
Addition CB 286, located at the SE corner of 27th NE and E. Price Street.
Shawn Napier reviewed the preliminary plat with commissioners. Motion was made by
John Lee, seconded by Jerry Akers to approve the preliminary plat, subject to the City
Engineer's recommendations. Motion carried 7 -0.
8. Meeting adjourned at 5:51 p. m.
