The Board ofAdjustment meeting was called to order by Jerry Maning, Vice - Chairman at
12:03 p. m.
A. The following members were present: David Hamilton, Jerry Haning, Marilyn
Smith, Louise Hagood and Deanna Manning
B. Also present was Shawn Napier, Director of Engineering, Planning and
Development; Sue Lancaster, City Council; Dale Maberry, Fire Marshal; Shane
Grissom, Engineering Technician; Ashley Fendley, City Staff and concerned
citizens.
2. Election of Officers:
A. Chairman — Motion was made by Jerry Haning, seconded by Marilyn Smith to
nominate David Hamilton as Chairman. Motion carried 4 -1, with David Hamilton
casting the dissenting vote.
B. Vice - Chairman — Motion was made by Louise Hagood, seconded by Deanna
Manning to nominate Jerry Haning as Vice - Chairman. Motion carried 4 -1, with
Jerry Haning casting the dissenting vote.
3. Approval of minutes from previous meetings. (May 12, 2015)
Motion was made by Marilyn Smith, seconded by Jerry Haning to approve minutes for the
May 12, 2015 meeting. Motion carried 5 -0.
4. Public hearing and consideration of and action on the petition Skyler Burch inal on Lot 7,
part of 8 and 9, City Block 249, being located in the 2500 Block of Lamar Avenue.
A. To grant a variance of Zoning Ordinance 1710, Section 9 -602 (8) which requires a ten
(10) foot side yard separation from a residential district. The applicant is proposing a
three (3) foot side yard, which is a 7 foot variance. This variance request is for both
side yards.
B. To grant a variance of Zoning Ordinance 1710, Section 9 -701 (2) which requires a
minimum rear yard often (10) feet. The applicant is proposing a three (3) foot rear
yard, which is a 7 foot variance.
Public hearing was declared open.
A. No one spoke in favor of the petition.
B. Four individuals spoke in opposition.
Donie Hussey, 3231 Hubbard Street Paris, Texas, spoke in opposition of the
petition. Mrs. Hussey stated that her property is to the east of the subjected property
and she believes that constructing storage units is not the best use for this land. Mrs.
Hussey further stated that she has concerns about the property value, security
issues, traffic flow and drainage issues.
Pat Bolton, 205 S.E. 25th Street Paris, Texas, spoke in opposition of the petition.
Mrs. Bolton stated she has been a resident here for forty -one (41) years. In those
years, she has experienced flooding issues and with buildings being built three (3)
feet from her property line the issues might get worse. Mrs. Bolton further stated in
order for Mr. Burchinal to construct these storage units he would have to cut down
several trees that shade the residents on S.E. 25th Street.
Tracy Hoffart, 155 S.E. 25th Street Paris, Texas, spoke in opposition of the petition.
Ms. Hoffart stated she has concerns about security issues, trash from the storage
renters, noise issues and rodents coming from the storage units.
Paul Landers, 135 S.E. 25th Street Paris, Texas, spoke in opposition of the petition.
Mr. Landers stated that the zoning ordinance has these setbacks for a reason and
they shouldn't be changed. Mr. Landers further stated that S.E. 25th Street already
has issues with flooding and with water coming off these storage units only being
three (3) feet from the property line will make the issue worse.
Public hearing was declared closed.
Shawn Napier, City Engineer stated that a gas line exists on the west side of this property.
Atmos Energy Corporation appears to have an easement for the gas line. The easement is
not defined, but rather described as a blanket easement. The addition of an easement is
done during the platting process. Mr. Napier further stated for maintenance the gas
company will need more than three feet to work. Atmos will be providing information
concerning needed work space and proposed easement width that could be added to the
plat. Jerry Haning asked Dale Maberry, Fire Marshal about the fire lanes. Mr. Maberry
stated that the inside units would be accessible but not the outside of the building if there
was only three (3) feet from the property line.
Motion was made by Jerry Haning, seconded by Louise Hagood and Deanna Manning to
deny the variance request. Motion carried 5 -0.
