10/19/2015 MINUTESMINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION MONDAY, OCTOBER 19, 2015 3:30 P.M. 1. Johnny Norris called the Building and Standards Commission Meeting to order at 3:30 P.M. Roll was called. A. The following members were present: Johnny Norris Ben Vaughan Matthew Allen Ken Kohls Chad Lindsey Charles Richards Sally McEwin B. Staff present: Robert Talley Nicki Brown Stephanie Harris C. Others present: Benny Plata — City Council Stephanie Harris — (arrived at 3:32pm) City Attorney Kenny Kammer — Property Owner 2. Approval of minutes from previous meetings. (September 21, 2015) Motion was made by Ben Vaughan and seconded by Ken Kohls to approve the minutes for September 21, 2015 meeting. Motion carried unanimously. 7 -0 3. Public Hearing to consider presentations by City of Paris Code Inspectors and owner(s) and /or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures ": D. 2311 Lamar; City block 222 -A, Lot 7 Owner: Kammer Property Arrangements Inc. 1728 Maple Ave. Paris, TX 75460 No Taxes Owed There is fire damage on the buildings. Mr. Kammer stated that he is salvaging everything he can and would like 90 days to complete the demolition of the structures. He stated the utilities are cut off already. Robert Talley's recommendation: 90 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Charles Richards, seconded by Chad Lindsey to accept Robert Talley's recommendation. Motion carried unanimously. 7 -0 A. 418 — 420 SE 10th; Boyd- McGlasson Addition Block 2, Lot 10 & S 31' of 9 Owner: Eugene & Krista Johnson 500 Hickory St. Honey Grove, TX 75446 Taxes Owed: $10,528.61 No contact with owner We have had a lot of complaints about people going in and out of this property. The east side code enforcement officer has worked this property several times and the City work crew is mowing the property. The structure is unsecure, it has plants growing inside of it, there are holes in the roof, people are stripping the wiring out of it, and there is also another shed in the back that will be addressed at another time. There was a discussion of securing the property and who adsorbs the cost of the demolition. Robert Talley's recommendation: 10 days to secure and 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Sally McEwin, seconded by Chad Lindsey to accept Robert Talley's recommendation. Motion carried unanimously. 7 -0 B. 1005 E Hearon; Nancy Wright Addition Block C, Lot 1 & 2 Owner: MA Maison, LTD 867 Pasatiempo Drive Frisco, TX 75034 No Taxes Owed Robert Talley has had no contact with the owner. Robert stated that this is an out building and someone has been demolishing it already. There is missing tin and most of the roof it already gone. Robert Talley's recommendation: 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Ben Vaughan, seconded by Sally McEwin to accept Robert Talley's recommendation. Motion carried unanimously. 7 -0 C. 602 SE 10th; City Block 113, Lot 16 -A & PT of 17 Owner: George L Preston 16 Clarksville Paris, TX 75460 No Taxes Owed Robert Talley talked to George Preston and he has already pulled a demolition permit. George asked for 90 days to complete the demolition. Robert Talley's recommendation: 90 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Matthew Allen, seconded by Charles Richards to accept Robert Talley's recommendation. Motion carried unanimously. 7 -0 E. 2360 E Price; City block 222 -A, Lot 21 Owner: Par Trust CIO JL Moore Trustee 813 Simmons Euless, TX 76040 Taxes Owed: $12,891.63 Robert Talley stated the carport has junk and rubbish, holes in the ceiling, the back of the house has broken windows and is unsecure, lots of damage to the house, holes in the roof, junk and rubbish inside the house and the roof is starting the dip. Discussion about minimum time allowed before we can demo. 30 days by State law. Sally McEwin asked if this owner owns several properties is that no recourse we have against them to recuperate some of the money we spend. Stephanie Harris stated that it's possible to sue the property owner unless they have no assets. The committee asked that this property be moved up on the demo list since it's across from the park to reduce safety issues. Robert Talley's recommendation: 10 days to secure and 30 days to demolish if not the City has the right to demolish and apply a $1000 per day civil penalty. Motion was made by Ben Vaughan, seconded by Sally McEwin to accept Robert Talley's recommendation. Motion carried unanimously. 7 -0 4. Code Enforcement Update Five structures were presented to BSC and eight were demolished in the month of September. Johnny Norris asked if the Tax Attorney would come speak to the commission again for the new members to understand more and for them to ask questions. Robert Talley stated he would invite him back. Robert Talley stated that there are around 50 properties still on the list to be demo'ed. Johnny Norris asked about the funds left and Robert Talley stated the new year just started the first of October so funds are good. Robert Talley is still working on bringing rubbish cases to the Building and Standard Commission. He is working with Chip Matthews to get this started. 5.
