19 - INSTALL NO PARKING ZONEItem No. 19 memorandum TO: City Council John Godwin, City Manager FROM: Randy Tuttle, Assistant Chief of Police SUBJECT: INSTALL NO PARKING ZONE DATE: February 03, 2016 BACKGROUND: The City of Paris Traffic Commission was forwarded a request from Department of Public Safety requesting the installation of a No Parking Zone in the 4200 block of Bonham. Texas Department of Public Safety recently opened a new office at this location. They now inspect commercial vehicles and have issues with commercial vehicles parking on Bonham St. creating a traffic hazard. The Department of Public Safety has parking area to accommodate commercial vehicle parking. STATUS OF ISSUE: On February 02, 2016, the Traffic Commission considered the item to place a No Parking Zone on south side of Bonham from 41s` SW west to 44`h SW. The Traffic Commission voted to recommend this be approved. BUDGET: Estimated $200.00 impact on current Traffic Department budget to make necessary changes. RECOMMENDATION: Approve change of official traffic control map to place a no parking zone as recommended by Traffic Commission. Draft ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING THE TRAFFIC CONTROL MAP ADOPTED IN SECTION 31 -65 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; ESTABLISHING A NO PARKING ZONE ON THE SOUTH SIDE OF BONHAM STREET FROM 41sT SW WEST TO 44TH SW; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING FOR A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Traffic Commission at its regular meeting on February 2, 2016, considered and voted to approve a request from the Department of Public Safety for a no parking zone on the south side of Bonham Street from 41St SW west to 44th SW, as depicted in Exhibit "A" attached hereto, because of reports that semi - tractor trailer vehicles are parking on the shoulder causing traffic congestion and posing a danger to other traffic; and, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Traffic Control Map adopted in Section 31 -65 (b) of the Code of Ordinances of the City of Paris, Texas, be, and the same is hereby, amended to include the following No Parking Zone: "On the south side of Bonham Street from 41St SW west to 44th SW.PP Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 5. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be subject to a fine in accordance with provisions of Section 1 -6 of Chapter One of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above - enumerated sections shall constitute and be deemed a separate offense. Section 7. This ordinance shall become effective from and after its passage and publication as required by law. PASSED AND ADOPTED this 22nd day of February, 2016. A.J.
