11 - CHANGE SPEED ZONEItem No. 11 memorandum TO: City Council John Godwin, City Manager FROM: Randy Tuttle, Assistant Chief of Police SUBJECT: CHANGE SPEED ZONE DATE: May 04, 2016 BACKGROUND: The City of Paris Traffic Commission was forwarded a request from citizens requesting the speed zone in 10 block of 2nd SE between Lamar and Clarksville be changed to 20 mph for safety of the children playing in the new park. The current speed is 30 mph. STATUS OF ISSUE: On May 03, 2016, the Traffic Commission considered the item to change the speed zone on 2nd SE to 20 mph. The Traffic Commission voted to recommend this be approved. BUDGET: Estimated $200.00 impact on current Traffic Department budget to make necessary changes. RECOMMENDATION: Approve change of official traffic control map to change speed zone as recommended by Traffic Commission. DRAFT ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING THE TRAFFIC CONTROL MAP ADOPTED IN SECTION 31 -65 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; CHANGING THE SPEED ZONE IN THE 10 BLOCK OF 2ND SE BETWEEN LAMAR AVE AND CLARKSVILLE STREET TO 20 MPH FROM 30 MPH FOR SAFETY OF THE CHILDREN PLAYING IN THE NEW PARK, MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Traffic Commission at its regular meeting of May 3, 2016, 2014, considered an item to change the speed zone in the 10 block of 2nd SE between Lamar Avenue and Clarksville Streets from the current 30 MPH speed limit to 20 MPH for the safety of the children playing in the new park; and WHEREAS, The Traffic Commission voted to recommend the speed zone be changed to 20 MPH. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Traffic Control Map adopted in Section 31 -65(b) of the Code of Ordinances of the City of Paris, Texas, be, and the same is hereby, amended to show the speed limit in the 10 block of 2nd SE between Lamar Avenue and Clarksville Street as 20 MPH. Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section S. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be punished by a fine not exceeding TWO HUNDRED AND NO /100 ($200.00) DOLLARS. Section 7. This ordinance shall become effective immediately upon passage. PASSED AND ADOPTED this 23rd day of May, 2016. A.J.
