1. The Board of Adjustment meeting was called to order by David Hamilton, Chairman at
12: 01 p.m.
A. The following members were present: David Hamilton, Marilyn Smith, Jerry
Haning, Louise Hagood and Deanna Manning
B. Also present was Ashley Fendley, City Staff; Sue Lancaster, City Council;
Stephanie Harris, City Attorney; Admiral Smith, Applicant and Concerned
Citizens
2. Approval of minutes from previous meetings. (November 17, 2015)
Motion was made by Louise Hagood, seconded by Deanna Manning to approve minutes
for the November 17, 2015 meeting. Motion carried 4 -0.
Marilyn Smith arrived at 12:02 p.m.
3. Public hearing and consideration of and action on the petition of Admiral Smith on Lot 2 and 3,
City Block 74B, being located at 311 E. Provine and 812 N.E. 3rd Street.
A. To grant a variance of Section 9 -102 (1) of the Zoning Ordinance which provides that
"The minimum lot area for a residential home in Two - Family Dwelling District (2F) be
6, 000 square feet. " The applicant's property is a 4,258 square foot lot. The applicant is
asking for a 1, 742 square foot variance for the lot size.
B. To grant a variance of Section 9- 201(1) of the Zoning Ordinance which provides that "The
minimum lot width for a residential home in Two - Family Dwelling District (2F) be 60 feet
wide. " The applicant's property is 30 feet wide. The applicant is asking for a 30 foot
variance for the lot width.
C. To grant a variance of Section 9- 301(1) of the Zoning Ordinance which provides that "The
minimum lot depth for a residential home in Two - Family Dwelling District (2F) be 100feet
deep. " The applicant's property is 84.5 feet deep. The applicant is asking for a 15.5 feet
variance for the lot depth.
Public hearing was declared open.
A. One individual spoke in favor of the petition.
Admiral Smith, 600 CR 45080 Powderly, Texas, spoke in favor of the petition. Mr.
Smith stated that these properties were willed over to him by his grandmother and
he has been taking care of the property for a couple years. Mr. Smith stated that he
wants to construct a single family one bedroom home at 311 E. Provine and 812
N.E. 3' Street. Mr. Smith stated that he has contacted Brandon Chaney with
Chaney Engineering to plat the two lots together to be able to move forward with
his plans. Mr. Smith further stated he hopes the board will approve his variances to
move forward with the process.
B. Three Individuals spoke in opposition of the petition.
Jackie Moreland, 303 E. Provine Paris, Texas, spoke in opposition of the petition.
Mrs. Moreland stated that she has lived at her residence for thirteen years and no
one has ever taken care of the property. Mrs. Moreland stated that she believes that
the lot is too small for someone to build a home.
Victoria Lane, 319 E. Provine Paris, Texas, spoke in opposition of the petition.
Mrs. Lane stated that the property is too small to construct a home on and that the
owner has not been taking care of the property.
Eric Lane, 319 E. Provine Paris, Texas, spoke in opposition of the petition. Mr.
Lane stated that the property is too small to construct a home on it.
Public hearing was declared closed.
Motion was made by Louise Hagood to approve the variance request. Motion died for a
lack of a second.
Motion was made by Jerry Haning, seconded by Marilyn Smith to deny the variance
request. Motion carried 4 -1, with Louise Hagood in opposition.
4. Meeting adjourned at 12:27 p.m.
