Item No. 13 <br />hfffl�,W <br />TO: Mayor & City Council <br />Grayson Path, City Manager <br />FROM: Carla Easton, PE, Engineering & Community Development Director <br />SUBJECT: ZONING CHANGE / SITE PLAN MODIFICATION, 4230 PRIMROSE <br />DATE: June 22, 2020 <br />BACKGROUND: The Primrose Village subdivision located on 42nd SE was developed as a <br />single family neighborhood with a zero -lot -line concept in the early 90's, allowing homes to be <br />constructed on or very near to the lot lines. This is allowed under Planned Development zoning <br />where a site plan is provided, which essentially provides the regulations for all future <br />development. Deviations from the approved site plan are not allowed unless the site plan is <br />formally revised in the same manner as a zoning change. All structures are to comply with <br />building codes at time of permitting. <br />STATUS OF ISSUE: Doreen Ruthhart has submitted a modified site plan on behalf of Ron Doe <br />Homes for lots 3 and 4 of the Primrose II Subdivision, in order to build a more traditional style <br />home with minimum building setbacks. This is in response to a requirement in the International <br />Residential Code (IRC) to provide fire -rated walls where minimum building separation is not <br />met. Under the current approved site plan from 1994, both side walls on a new home would <br />need to be fire -rated, as they would be built on or near the lot line. The owner/builder is <br />proposing to combine two lots in order to construct a home meeting the minimum requirements <br />in the IRC without fire -rated walls. <br />A modified site plan has been submitted for consideration by the commission. If approved, a <br />home constructed in this way will not be visually consistent with the existing five homes on the <br />street, so the expectation of neighboring property owners should be closely considered as part of <br />the site plan approval. Notifications were mailed to all properties within 200 feet, and staff <br />received several calls from concerned neighbors regarding this change. Two property owners <br />from the neighborhood attended the Planning & Zoning meeting, and ultimately said they were <br />not opposed to the site plan change so long as a single family home is built. <br />
