D. Section 28 -6 (d)(5) of the Sign Ordinance which provides that "Except as provided <br />herein, billboards shall not be placed within five hundred (500) feet of other <br />permanent signs. " The applicant's proposed billboard is within five hundred (500) <br />feet of other permanent signs. <br />E. Section 28 -6 (d) (7) of the Sign Ordinance which provides that "No part of a <br />billboard shall be located closer than one thousand (1, 000) feet to any property <br />zoned or used for residential purposes, nor closer than three hundred (300) feet to <br />any hotel, motel, nursing home, or other property used for sleeping or lodging <br />purposes. " The applicant's proposed billboard is within one thousand (1, 000) feet <br />of a residential zoning district and within three hundred (300) feet of a hotel. <br />F. Section 28 -6 (d)(8) of the Sign Ordinance which provides that "No portion of a <br />billboard shall be located closer than fifteen (15) feet to the right -of -way for <br />existing streets or highways, or those projected in the city's thoroughfare plan. " <br />The applicant's proposed billboard is approximately within the fifteen (15) feet <br />from the right -of -way. <br />Public hearing was declared open. <br />A. One individual spoke in favor of the petition. <br />Jimmy Parker, 23478 I -30 Bryant, Arkansas, spoke in favor of the petition. Mr. <br />Parker stated that he represents the Everett Family owners of Toyota. We are <br />looking to place a billboard on the church property. The billboard wouldn't be for <br />lease space it would provide ads for Everett Toyota, Paris Church of Christ, Red <br />Cross, Schools, Lamar County Chamber of Commerce and the City of Paris. Mr. <br />Parker stated they understand that they are asking for several variances but there are <br />existing signs inside the loop. Mr. Parker further stated he hopes the board will <br />approve the variances to build the first of its kind in the City of Paris. <br />B. Three individuals spoke in opposition of the petition. <br />James Martinez, 820 S.E. 47th Street Paris, Texas, spoke in opposition of the <br />petition. Mr. Martinez stated he has a billboard company and he does not believe <br />that this variance should be approved. Mr. Martinez stated that he has applied for <br />several billboard with the similar request and they have all been denied. Mr. <br />Martinez further stated if these request were to be approved he would expect the <br />same for his own company. <br />Sue Banks, 3450 Robin Road Paris, Texas, spoke in opposition of the petition. Mrs. <br />Banks stated that she has lived at her residence for thirty-eight years and wants to <br />keep the neighborhood clean. Mrs. Banks stated that there are already safety issues <br />
