Commissioner Dux <br />advised the other commissioners it is not necessary to remove items from the consent agenda that <br />could remain, and asked Commissioner Steely if he was agreeable to leaving items B & D on the <br />consent agenda. Commissioner Steely agreed. A motion was made by Commissioner Steely to <br />send items B & D to the Building and Standards Commission for action since the buildings have no <br />historical value and cannot be rehabilitated, seconded by Commissioner Alarid, Motion Carried 4 <br />-0 <br />Discussion on item A, 1421 W. Cherry: Commissioner Steely stated the house was in bad shape, <br />but also noted there were two others around the house that are in just as bad shape. Commissioner <br />Steely made a motion to save the structure until there is a plan. Commissioner Dux asked <br />Commissioner Steely to clarify who he wants to have a plan. Commissioner Steely said he wanted <br />to see the City of Paris have a master plan to go through the blocks, before he would vote yes on <br />any other houses being demolished. Commissioner Dux reminded all Commissioners that Historic <br />Preservation Commissions responsibilities are to determine whether the structure has any <br />historical significance that deems it worthy of saving, and if so, the Historic Preservation <br />Commission must come up with a plan on rehabilitation. Commissioner Steely said he wants to <br />vote not to send the house to the Buildings and Standards. Commissioner Alarid then stated that he <br />would vote not to send the house, because the piecemeal abating of federal law is unacceptable <br />and breaking the spirit of the law. He commented, "The spirit of the law says do the abating first, <br />and Robert says if he does S houses we can forget federal law, if we do more than that we have to <br />follow. " Commissioner Alarid mentioned the city should follow all of the law and not break the <br />spirit of the law of the abatement, because when the buildings are being demolished everybody's <br />health is in danger. Commissioner Dux then asked if there is a motion to save item A because of its <br />historical significance and if so, please indicate what is the historical significance. Commissioner <br />Alarid asked if the commissioner had any proof if it is historical. He didn't know, but it looked old <br />to him. Commissioner Dux stated it was up to the commission to determine this. Commissioner <br />Barbee made the motion to table item A until the next meeting, seconded by Commissioner Steely, <br />Commissioner Dux asked for any discussion before going to a vote. <br />Robert Talley, Code Enforcement reminded the commission that the two structures are unsecure, <br />an attractive nuisance, and dangerous, and this is why they have been placed on the list to go to <br />buildings and standards commission. They have to go to buildings and standards before there <br />can be an order on them, even if the order was to secure them. He informed the commission that <br />both of the structures' roofs are collapsing. He reminded them if they intend to table it, the <br />commission would be leaving a dangerous structure in the city and prolonging the process. He is <br />recommending they go to Buildings and Standards for demolition because of their dangerous <br />condition so Building and Standards commission can make a decision. <br />Hearing no other discussion Commissioner Dux called for a vote. Motion carried 3 — 1, <br />Commissioner Dux dissenting. <br />Discussion on Item C, 408 NE 10`h Street. Commissioner Steely asked if there was a background <br />on the house. Robert Talley told the commission that the house had been to Building and <br />Standards and ordered to repair. The owner (Mrs. Canister) has since passed away and didn't <br />complete all the repairs and now others removing the boards. Commissioner Dux asked that if <br />there was a previous order to repair, does it continue until the commission makes a different <br />
