memorandum <br />TO: Mayor & City Council <br />John Godwin, City Manager <br />FROM: Alan Efrussy, AICP, Planning Manager <br />SUBJECT: PUBLIC HEARING REGARDING INCLUDING A DISTILLERY USE <br />WITHIN THE ZONING ORDINANCE <br />DATE: January 4, 2017 <br />BACKGROUND: A potential applicant has recently met with city staff and he has requested the <br />opportunity to develop a distillery. Within the Zoning Ordinance, Section 8 -109. Classification <br />of New and Unlisted Uses requires that the city staff provide a recommendation to the Planning <br />and Zoning Commission and the commission provide its recommendation to the City Council. <br />At the December 5, 2016 Planning and Zoning Commission meeting discussion, the commission <br />voted unanimously to conduct a future public hearing to include the enclosed recommended <br />definition of a distillery in the Zoning Ordinance, and to allow distilleries as a permitted use in <br />the Light Industrial (LI) and Heavy Industrial (HI) Zoning Districts and to allow distilleries in <br />the Commercial (C) and the General Retail (GR) Zoning Districts, with regulation, only through <br />the Specific Use Permit (SUP) process. At the January 3, 2017 Planning and Zoning <br />Commission meeting no one spoke either in favor of or in opposition to this request. The <br />commission unanimously recommended approval of the request to the City Council. <br />STATUS OF ISSUE: The city staff has determined the following: <br />(A) An accepted definition of a distillery is as follows: "A distillery is an establishment where <br />alcoholic beverages are made through distillation. Distilleries may also include accessory uses <br />such as office space, sampling/tasting rooms, and restaurants and bar /taverns, and differ from <br />micro distilleries by virtue of their scale and their principle purpose as a manufacturing facility <br />for these liquors. A distillery facility shall produce liquors or spirits in accordance with any <br />manufacturing and /or wholesaling license in accordance with and required by federal, state, and <br />local requirements." <br />(B) To aid the Planning and Zoning Commission and the City Council in their determination <br />regarding allowing a new or unlisted use, the Zoning Ordinance requires staff to comment on the <br />following: Nature of the use: A distillery can be either industrial oriented or even a <br />
