No one spoke in opposition. <br />Charles Morrisman, 2440 Highland Road, property owner, stated he is not opposed <br />to the development; he just had concerns regarding drainage. He stated the back <br />side of our property floods, what will they do to address the flooding issues that <br />already exist in the neighborhood. Shawn Napier stated that this site does have a <br />detention pond to help slow down the water, which is required. Chairman Chalaire <br />stated that the water flow will be directed to 25th Street N.E. and the detention pond <br />which will slow down the water; so the water flow will not increase, it will remain <br />the same as it was prior to development. <br />Motion was made by Keith Flowers, seconded by Jerry Akers to approve the Site Plan, <br />subject to the City Engineer's recommendations. Motion carried 5 -0. <br />4. Consideration of and action on the Preliminary Plat of Lots 1 and 2, Block B, Morningside <br />North #2 Addition, being located at 4200 Block of Lamar Avenue. <br />Shawn Napier, City Engineer, stated Mr. Glass brought in an updated preliminary plat with <br />all of the recommendations addressed except for item 2, the 5 feet right of way dedication. <br />Mr. Glass submitted a letter for the 5 foot right of way dedication. David Glass stated <br />the transaction called for a 28 foot ingress /egress easement. Shawn Napier stated this is <br />much larger than what he called for originally. Chairman Chalaire stated effectively what <br />they are asking for is an exception to item 2 of the Engineer's memo for the 5 foot right of <br />way dedication. Chairman Chalaire asked when this property was originally platted in <br />1988 was the major thoroughfare plan in place. Shawn Napier stated he was unable to <br />find one for that time, if there was one in place. David Glass stated he didn't see a written <br />document, however at that time we were required to put 42nd to connect to Morningside <br />and line in curb to Lamar. There was a thoroughfare plan in effect at that time, the City <br />did opt out of participating in the plan, or participate financially to widen the road to the 60 <br />foot. Mr. Glass further stated they have followed what the City required at that time and <br />have complied at this time. The houses built behind this property are on a zero lot line and <br />he can't see how they could ever widen that road. Motion was made by Richard Hunt, <br />seconded by Keith Flowers to approve the preliminary plat, subject to the City Engineer's <br />recommendations except for item #2. Motion carried 5 -0. <br />5. Consideration of and action on the Final Plat of Lots I and 2, Block B, Morningside North <br />#2 Addition, being located in the 4200 Block of Lamar Avenue. <br />Shawn Napier, City Engineer, stated that the recommendation memo includes all the same <br />comments as the preliminary plat except for item 6. <br />Motion was made by Jerry Akers, seconded by Keith Flowers to approve the final plat, <br />
