Mr. Beck further asked the board to approve the variance. <br />Chester Martindale asked if the owner of the center approves the sign size. Mr. <br />Beck stated yes he does support what is permutable to city code. Terry Christian <br />stated he is concerned about sign encroaching on other suite, thought the column <br />was egress. Mr. Beck stated he was also concerned and will ensure the sign is <br />centered. Kyle McCarley asked if the signs a present designed, and will it cost the <br />Girl Scouts to redesign to meet sign ordinance. Mr. Beck state no they are built as <br />needed, however, he already built the sign before he applied for a permit. Terry <br />Christian expressed concern about granting the variance and the effect it could have <br />on the rest of the center. <br />B. No one spoke in opposition. <br />Public hearing was declared closed. <br />Motion was made by Rick Hundley, seconded by Kyle McCarley to deny the variance <br />request. Motion carried 3 -1. <br />4. Public hearing and consideration of and action on the petition of Mitchell White to grant a <br />variance of Zoning Ordinance No. 1710, Section 9- 602(5), to modify the required side yard <br />setback from 25' to 8, which would be a 17' variance, on Lot 8, City Block 257 D, being <br />number 2702 E. Cherry Street. <br />A. Public hearing was declared open. <br />Mitchell White, 2702 E. Cherry St., home owner, Mr. White stated carport was <br />there for 23 years but, recently the whole thing came down. The new carport will <br />be a foot shorter. His wife has been disabled since 1992 with a broken vertebrae in <br />her neck. If it is raining, sleeting or snowing it would be hard on his wife. Mr. <br />White stated he is asking for the variance to be granted. <br />B. No one spoke in opposition. <br />Public hearing was declared closed. <br />Motion was made by Chester Martindale, seconded by Kyle McCarley to grant the <br />variance. Motion carried 4 -0. <br />5.
