questioned if they had approved the color of the stain. Mr. Starrett <br />asked the HPO to send a notice to the Pendletons that they had <br />exceeded the scope of their design. No official action was taken on <br />this item. <br />D. Substandard buildings owned by the City of Paris. Chairman Starrett <br />stated that some of the worst buildings in the downtown were owned <br />by the City of Paris, such as the McDonald building and the old Paris <br />News building. He asked if the City would at least replace broken <br />glass. No official action was taken on this item. <br />4. Closed session pursuant to Section 551.071 of the Texas Government Code, <br />Consultation with Attorney, to receive advice of legal counsel pertaining to <br />pending or possible litigation: <br />A. Brown v. City of Paris, et al, Cause No. 72322, 6th Judicial Court for <br />Lamar County, Texas. Motion to go into closed session was made by <br />Barbara Wilson, seconded by Sue Lancaster. Motion carried 6 -0. The <br />Commission went into closed session at 12:53 p.m. <br />Motion to return to open session was made by Paul Denney, seconded <br />by Barbara Wilson. Motion carried 6 -0. The Commission came back <br />into open session at 1:46 p.m. <br />Motion to excuse Chairman Starrett was made by Sue Lancaster, <br />seconded by Claudia Hunt. Motion carried 6 -0. <br />5. Request items from Board for future agendas. Vice - Chairman Wilson called <br />for items. The Commission asked that the City attempt to preserve the <br />remaining brick at Hearne Street. No other items. <br />6. Receipt of report from the Historic Preservation Officer. The HPO reported on <br />the following items: <br />A. COA Violation Notices: <br />(1) Gulf Station - They have repainted back to the previous color. <br />(2) TechTronics (next door) - They have repainted back to the <br />previous color. <br />(3) Jay Firsching - At the last meeting, Jay mentioned that Ft. <br />Worth's ordinance allows them to make people repaint when <br />they don't get or don't follow a COA. The HPO asked Jay to send <br />me a copy of the ordinance so that we can get that wording into <br />ours. <br />
