<br />DEPARTMENT OF TRANSPORTATION <br />FEDERAL AVIATION ADMINISTRATION <br />SOUTHWEST REGION <br />FORT WORTH, TX 76193-0056 <br /> <br />RIGHT-OF-ENTRY PERMIT <br /> <br />1. For and in consideration of the sum of One dollar ($1.00) and other <br />valuable considerations, the receipt of which are hereby acknowledged, <br />the City of Paris, P.O. Box 9037, Paris, TX 75461, hereinafter called <br />the Owner of the following described property located in Lamar County, <br />State of Texas: <br /> <br />This site is situated on the Paris, Texas, Municipal Airport (Cox <br />Field) and is more particularly shown on Exhibit "A", Airport Layout <br />Plan, attached hereto and by this reference made a part of this permit. <br /> <br />The Owner does hereby grant to the Federal Aviation Administration, <br />hereinafter called the Government, the right and privilege, for a period <br />of 180 days from the date hereof, to enter upon the land described <br />herein for the purpose of making such surveys, and conducting such tests <br />with portable or other electronic equipment, as may be necessary to <br />determine whether said property, or any portion thereof, is suitable for <br />the establishment of an communication/navigational facility. <br /> <br />2. The Owner further agrees, in the event the property or any portion <br />thereof is determined by the Government to be suitable for a <br />communication/navigational facility, to enter into negotiations for a <br />realty agreement covering necessary land requirements, together with the <br />right of ingress and egress thereto, from the nearest public or private <br />road. <br /> <br />3. All tools, equipment, buildings, improvements, and other property <br />taken upon or placed upon the land by the Government shall remain the <br />property of the Government and may be removed by the Government after <br />the expiration of this right-of-entry permit. <br /> <br />4. It is understood and agreed that if the Government does not acquire <br />title or other necessary interest in said land prior to the expiration <br />of this permit, the Government agrees to be responsible for any damage <br />arising from the activity of the Government or its agents on said lands, <br />in the exercise of rights under this permit, and shall repair such <br />damage, or, in lieu thereof and at the option of the Government, shall <br />make a cash settlement with the Owner. <br /> <br />EXHIBIT A <br />
