John Godwin, City Manager discussed the background stating Jim Lester Auto Repair has <br />applied for a zoning change on a 0.123 acre lot at 418 13th Street SW. The purpose of this <br />request is to change the zoning from SF -2 Residential to Commercial in order to bring this <br />property into compliance. The property includes a single family structure and a shed -type <br />building that is currently used for mechanical repairs of motor vehicles. This is not an <br />allowable home use, so the current activity is in violation of the city's zoning ordinance. <br />STATUS OF ISSUE: A majority of the area is zoned single family. A single large area on the <br />east side of 13th is zoned light industrial. The future land use plan calls for entirely low <br />density residential (single family), so the long-term goal of the plan is for even that single light <br />industrial site to eventually be converted to single family. The City therefore believes the <br />current zoning should remain the same. The fact that granting the change would bring the <br />property into compliance is not a relevant factor. The existence of an ordinance violation is, if <br />anything, a mark against the request. <br />Public hearing was declared open. <br />No one spoke in favor or opposition. <br />Public hearing was declared closed. <br />Motion was made by Chad Lindsey, seconded by John Lee to deny the zoning change. <br />Motion carried 7-0. <br />6. Public hearing to consider and take action regarding the petition of Jimmy Rowland for a <br />change in zoning from a One -Family Dwelling (SF2) to a Multiple -Family Dwelling (MFI), in <br />the Highland Park Addition, Block 4, Lot 7-A & ALL 8, 0.2470 Acres being located at 2015 & <br />2023 Culbertson Street. <br />John Godwin, City Manager discussed the background stating Jimmy Rowland has applied <br />for a zoning change on a 0.247 acre lot at 2015 and 2023 Culbertson. The purpose of this <br />request is to change the zoning from SF -2 Residential to MF -1 Residential in order to bring <br />this property into compliance. The property includes a single family house, behind which is <br />a garage apartment occupied by a tenant in violation of the current zoning. This request <br />came forward at least partly due to complaints by neighboring property owner(s). <br />STATUS OF ISSUE: There is a triplex immediately to the west of the subject property <br />and a multi -family unit beyond that. In addition, some lots have been zoned multi -family; <br />however the neighborhood remains predominantly single family homes. The future land <br />use plan calls for the entire area to remain low density residential (single family), so it is <br />believed the current zoning should remain the same. The fact that granting the change <br />would bring the property into compliance is not a relevant factor. The existence of an <br />ordinance violation is, if anything, a mark against the request. <br />John Godwin, City Manager, states the City recommendation is to deny the zoning change <br />request. <br />
