ORDINANCE NO. 2019-009 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />ADOPTING AMENDMENTS TO THE "DESIGN STANDARDS FOR THE <br />HISTORIC DISTRICTS OF THE CITY OF PARIS, TEXAS"; PROVIDING A <br />PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A <br />SEVERABILITY CLAUSE; PROVIDING A REPEALER CLAUSE; AND <br />PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, the City Council adopted Ordinance No. 2002-033, the "Paris Historic <br />Preservation Ordinance," on June, 17, 2002 declaring that the protection, preservation, and <br />enhancement of districts and landmarks of architectural, archaeological, cultural, and <br />historic importance is a matter of public policy; and <br />WHEREAS, said Paris Historic Preservation Ordinance was codified as Chapter 7, <br />Article VI, "Historic Preservation," of the Code of Ordinances of the City of Paris; <br />WHEREAS, in furtherance of the goals set forth in the Paris Historic Preservation <br />Ordinance, the City Council did thereafter approve the creation of seventeen (17) Historic <br />Overlay Districts by ordinance; and <br />WHEREAS, pursuant to Sec. 7-155 of the Code of Ordinances, each creating <br />ordinance contained design guidelines and other appropriate regulations concerning the <br />exterior and site development or redevelopment of buildings in each Historic Overlay <br />District as those standards existed at the time of passage; and <br />WHEREAS, pursuant to Sec. 7-153(e) of the Code of Ordinances, the City Council has <br />vested in the Historic Preservation Commission the authority to, among other things, <br />approve or disapprove certificates of appropriateness for renovations or construction in <br />the Historic Overlay Districts and to prepare and promote design guidelines for landmarks <br />and districts; and <br />WHEREAS, on the Historic Preservation Commission adopted "Design Standards for <br />the Historic Districts of the City of Paris, Texas" (hereinafter, the "Design Standards") in <br />2009;and <br />WHEREAS, on or about April 11, 2018, the Historic Preservation Commission <br />approved certain amendments and clarifications to the Design Standards with respect to <br />windows, bricks, and fencing; and <br />WHEREAS, on June 11, 2018, in Ordinance No. 2018-016, City Council amended the <br />ordinances creating the seventeen (17) Historic Overlay Districts to incorporate the City's <br />Design Standards for Historic Districts; and <br />
