<br />Du~ing the per~~nnance of this contract, the contractor agrees I. follows:
<br />
<br />-(1) The contractor wi II not discriminate against any ~loyee or appl {cant for eq)loyment because of
<br />race, religion, color, gender, or nationaL origin. The contractor will take .fffnmattve action to
<br />ensure that appUcants are eq3loyed. and that tn9loyees are treated during eftl)loyment without regard

<br />M(2) The COntractor will, in alL solicitations or advertisements for empLoyees placed by or on behalf

<br />M(3) The contractor will send to each 'Labor union or representative-of ,workers with which he ha. .

<br />M(4) The contractor will corq:)ly with all provisions of Executive Order No. 11246, al amended, and the
<br />rulel, regulations, and relevant orders of the Secretary of Labor.-
<br />
<br />M(5) The contractor will furnish all info~tion and reports required by Executive Order No. 11246,
<br />.. emended, and by the rules, regulatioos, and order of the Secretary of Labor, or pursuant thereto, .
<br />and will penoit aceesa to hi. booka, records, and acc.....u.by the contracting egency and the Secretary
<br />of Labor for purposes of investigation to ascertain carpl ianee wi th such rules, regulations, and

<br />
<br />-(6) In the event of the contractor's nonc~liance with the non.discrimination clauses of this
<br />contract or with any of such rules, regulations, or orders, this contract IMY be cancelled, terminated,
<br />or suspended tn whole or in part and the contractor mey be declared ineligible for further S10verrment
<br />contracts in .ccordance with proc:e6Jres authorized in Executive Order No. 11246, .s amended, and such
<br />other aanctions may be Imposed and remedies invoked os provided in Executive Order 11246, as 8Ill8ndod,
<br />or by rule, regulations, or order of the Secretary of Labor, or as otherwise provided by law.-
<br />
<br />-(7) The contractor will include the provisions of Paragraphs (1) through (7) in every subcontract or
<br />purchase order l.Illess ex~ted by rules, regulations, or orders of the Secretary of Labor issued
<br />pursuant to Section 204 of Executive Order No. 11246, as amended, so that such provisions will be
<br />binding upon each subcontractor or vendor. The. contract wi.ll take such. action with respect to any
<br />subcontract or purchase oreler .. the contracting agency ..y direct as ..ans of enforcing such
<br />provisions, including' sanctions for nonc~l fance: >>Provided, howeveD, that In the event the

<br />E. Conflict of Interests
<br />
<br />1. No official or eOployee of the State or local government who f. authorized In hi. official capacity to
<br />negotiate, InIke, eccept, or approve, or to take part in such decisions regarding a contract or
<br />subcontract In connection with this project shall have any financial or other personal interest in any
<br />such contract.
<br />
<br />2~ No person perfonming services for the State or local- government in connection with this project shall
<br />have a financial or other personal interest other than his empl~t or retention by the State or
<br />local goverrment, in any contract of Sl.b:ontract in cornection with this project~ No officer or
<br />employee of such interest is openly disclosed upon the public records of the State, and such officer,
<br />employee or person has not perticipeted in the acquisition for or on behalf of the Participant.
<br />
<br />F. Project Costs
<br />
<br />Project Coats eligible for assistance shall be determined upon the basis of the criteria set forth by the
<br />TRPA Grent. Manual.
<br />
<br />GG Project Administration
<br />
<br />1. The sponsor shall proq>tly sub1llt such reports and dOCUlll!ntation as the Depar-..t may request.
<br />
<br />H. Retentl~ and CUstodial Requi roments for Records
<br />
<br />1.. Financial records, supporting docuDents, statistical records. and all other records pertinent to this
<br />grant sholl be retained for a period of three year. after final payment; except the records shell be
<br />ratained beyond the three-year period if audit findings have not been resolved.
<br />
<br />2~ The retention period starts frcn the date of the final expenditures report for the project.
<br />
<br />3. Microfil. copies are authorized in lieu of original records.
