<br />SectIon 3. AITACIDID\T, REPLACEMENT, RELOCATION AND MODIFICATION
<br />OF EQUlPMENT,

<br />3.1. Permit Amlicalion for the Al"''lchment. Replacement RrlO<'",tion or Modification of
<br />Eouinment. Throughout the term of this Agreement, City may designate certain of TU
<br />E!edric's Distribution Poles on which it desir~ to attach, replace, relocate or modify any
<br />Equipment, Each such designation will be made by submitting to TV Electric, at J~t .thirty
<br />(30) days before the dall: when City desiR:s to begin such work, a Permit Appliwion (generally
<br />in the form of Exhibit B attached herem) signed by an Authorized Representative of City and
<br />specifying the type of work City desires to perform and the Distribution PolC$ on which that
<br />work i$ to be performed, All Permit Applications must also contai.!l detailed specifications
<br />rcl!.ting to L'le perfarmance of such work, In addition, all attuhmCl'lts must be peri'onned in
<br />strict llCC(r.dance with Exhibit C, D. E, F a..,d G ~Itached here:o.

<br />3.2. TU Eicctric's Re;oo;w, 10 Permit Ann1ica!ion. TV Eleclric will, approve,
<br />conditionally approve ar deny each Permit Application for the at'.achmc.'ll, replacement,
<br />rcl"""';':>n or modification of ~uipment by returning one copy of it to City reflectinl: its
<br />approval, conditional approval or denial. TU Electric will make ~ good faith effon to either
<br />approve, conditionally approve or de.~y such Permit Ap?lications within thirty (30) da~ of it!

<br />the Pencil Application on the condition that City agrees to assu= ail risks and costs associat:d,

<br />Applic::u:ion 10 City reflecting its conditional approval and de!.2lling the :allachmc.-.ts that must be

<br />Permit Application must be accompa.,ie.::l by payment of the amoont of the estilT'.ated cost of
<br />making such modificatio:1 or rearrangement. Upon its rc;cipt of lile Permit Application and
