Section 1. That the findings set out in the preamble to this ordinance are hereby in all things <br />approved. <br />Section 2. That the Code of Ordinances of the City of Paris, Paris, Texas, Article III to <br />Chapter 34, Sections 34-51 through 34-131, entitled "Wastewater Discharge and Disposal", is hereby <br />repealed and replaced with a revised Article III to Chapter 34, Sections 34-51 through 34-131 to read <br />as follows: <br />"ARTICLE III. WASTEWATER DISCHARGE AND DISPOSAL <br />"DIVISION 1. GENERALLY <br />"Sec. 34-51. - Purpose, policy, and authority. <br />(a) Generally. It is the policy of the city to provide the planning, engineering and administration <br />necessary to develop and manage the publicly owned treatment works that are adequate for <br />the transportation, treatment and disposal of wastes from within the city and to operate the <br />sewer system in a manner which protects public health and the environment, and, in addition, <br />to enable the city to comply with any applicable state and federal laws including, the Texas <br />Water Code, the Clean Water Act of 1977 as amended and the General Pretreatment <br />Regulations (40 CFR Part 403). <br />(b) Application. This article shall apply to users of the city POTW and to persons outside the city, <br />who are, by contract or agreement with the city, users of the municipal publicly owned <br />treatment works and those persons who conduct activities in the city and its jurisdiction under <br />the provisions of this article. All connections of lateral or other sewer lines to the sewage <br />system of the city, whether within or without the city, shall be subject to such terms and <br />conditions as the city council may prescribe. <br />(c) Authority. The city, a home rule city, derives its authority from the Constitution and Laws of <br />the state and the Charter of the city to exercise all the power therein granted together with all <br />of the implied powers necessary to carry into execution all the powers granted. <br />No - ! <br />"Sec. 34-52. - Objectives. <br />(a) The objectives of this article are: <br />(1) To provide for the orderly functioning of the POTW: <br />(2) To provide control of construction and use of the city sewer system; <br />Page 2 of 45 <br />
