Sanctions imposed upon the user shall include, but not be limited to, any or all of the following <br />enforcement orders: Notices of violations, compliance orders, administrative orders, fines, civil <br />and criminal penalties, permit revocation, public notification of violation in the local news media, <br />termination of services, and joint enforcement action by the city, state, and/or federal regulatory <br />agencies. Minor violations escalate into enforcement actions of greater magnitude in the event of <br />recalcitrance by the user until full compliance is achieved. <br />This plan specifies methods of investigation of the violation, types of escalating enforcement <br />responses for any violation reasonably anticipated by the city and the title of the official(s) <br />responsible for implementing each type of enforcement response. The enforcement response plan <br />enables users of the POTW to anticipate enforcement action by the city. <br />Sec. 34-117. - Penalty for violation of article provisions. <br />(a) In accordance with the enforcement response plan required herein, any person in violation of <br />any of the provisions of this article may be issued an administrative order requiring <br />compliance and may include an administrative fine not to exceed two thousand dollars <br />($2,000.00). Each and every day's continuance of any violation of the provisions of this article <br />shall constitute and be deemed a separate offense. <br />(b) Any person violating any of the provisions of this article shall be guilty of a misdemeanor, <br />and upon conviction shall be fined in any sum not to exceed two thousand dollars ($2,000.00), <br />and each and every day's continuance of any violation of the provisions of this article shall <br />constitute and be deemed a separate offense. <br />Secs. 34-118-34-130. - Reserved. <br />DIVISION 4. TRUCK AND HAULED WASTES <br />Sec. 34-131. - Generation, transportation and disposal of wastes. <br />(a) Nonhazardous wastes. <br />(1) A generator of liquid wastes shall comply with the following provisions in addition to <br />compliance with other provisions of this article: <br />a. No generator of liquid wastes shall fail to have all liquid waste material removed <br />from his premises by a liquid waste transporter who holds a valid permit from the <br />city. <br />b. No generator of liquid wastes may have hazardous wastes or liquid waste in <br />combination with hazardous waste removed from his premises by a liquid waste <br />transporter operating under a city permit. <br />Page 38 of 45 <br />
