Discuss and act on ORDINANCE NO. 2020-028: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, REVISING ARTICLE III TO CHAPTER 34 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, ENTITLED WASTEWATER DISCHARGE AND DISPOSAL; APPROVING AND AUTHORIZING REVISIONS TO CHAPTER 34, ARTICLE III OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, ENTITLED WASTEWATER DISCHARGE AND DISPOSAL, IN CONFORMANCE WITH CURRENT ENVIRONMENTAL PROTECTION AGENCY AND TEXAS COMMISSION ON ENVIRONMENTAL QUALITY RULES, REGULATIONS, AND POLICIES IMPLEMENTING STREAMLINING RULE PROVISIONS; PROVIDING FOR PENALTIES; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALER CLAUSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Mr. Harris said the City of Paris administers an Industrial Pretreatment Program, as required by the U.S. Environmental Protection Agency and Texas Commission on Environmental Quality, under the Clean Water Act, Texas Water Code and 40 CFR Part 403. He also said that the EPA and TCEQ recently made changes in their rules, and municipalities were required to adopt those changes. A Motion to approve this item was made by Mayor Clifford and seconded by Council Member Hughes. Motion carried, 6 ayes — 0 nays. 29. Discuss and possibly act on ORDINANCE NO. 2020-029: AN ORDINANCE OF THE CITY OF PARIS, TEXAS, REPEALING ORDINANCE NO. 2017-003 AMENDING ARTICLE III, "SMOKING REGULATIONS," OF CHAPTER 17 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, SECTION 17.46, "DEFINITIONS," AND SECTION 17.53, "PROHIBITION OF SMOKING IN ENCLOSED PLACE OF EMPLOYMENT"; MAKING OTHER FINDINGS RELATED TO THE SAME; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A PENALTY CLAUSE AND PROVIDING AN EFFECTIVE DATE. Council Member Knox said she had requested this item be placed on the agenda. She said about four years ago an amendment was brought before the City Council in which they were asked for clarification or to maybe clean up some of the wording. Council Member Knox said when that happened, it created a loophole allowing certain industries to permit smoking in their facilities. She said she was asking for the amendment to be repealed, and to go back to the original ordinance so employees could work in a smoke free environment. A Motion to approve this item was made by Council Member Knox and seconded by Mayor Clifford. Motion carried, 6 ayes — 0 nays.
