<br />MEMORANDUM OF UNDERSTANDING <br />RENTAL REHABILITATION PROGRAM <br /> <br />This Memorandum of Understanding ("Memorandum") is made and entered into <br />and between the City of Paris, Texas, hereinafter referred to as "City", <br />and the Paris Housing Authority, hereinafter referred to as "PHA". This <br />Memorandum sets forth the understandings of the parties hereto concerning <br />City's Rental Rehabi 1 itation Program ("Program") under <br />the State Program as approved by the U.S. Department of Housing and Urban <br />Development ("HUD") pursuant to Section 17 of the United States Housing <br />Act of 1937 (42 USC 14370). <br /> <br />The City has received rental rehabilitation funds from the Texas <br />Department of Commerce, hereinafter referred to as "TDOC", in Federal <br />Fiscal Year 1988 for its Program to finance the rehabilitation of rental <br />properties for the benefit of lower-income families. The parties hereto <br />have severally and collectively agreed and by the execution hereof are <br />bound to the mutual obligations and to the performance and accomplishment <br />of the tasks described herein. <br /> <br />Section 1. CITY'S RENTAL REHABILITATION PROGRAM <br /> <br />The City will carry out its Rental Rehabilitation Program in accordance <br />with Section 17 of the U.S. Housing Act of 1937 (42 USC 14370) and other <br />applicable Federal laws; the regulations in 24 CFR Part 511; and the <br />Contract for Rental Rehabilitation Program ("RRP Contract") as made and <br />entered into by and between the City and TDOC. <br /> <br />SECTION 2. ADMINISTRATION OF VOUCHER PROGRAM <br /> <br />The PHA administers the Section 8 Existing Housing Voucher Program <br />funding provided by HUD in accordance with Section 8 of the U.S. Housing <br />Act of 1937 (42 USC 1437f) and other applicable Federal laws; the <br />regulations in 24 CFR Part 882; the Notice of Funding Availability for <br />Section 8 Housing Voucher dated July 12, 1984; and other HUD regulations <br />and requirements including the Annual Contributions Contract ("ACC") as <br />made and entered into by and between HUD and the PHA, and the <br />Administrative Plan and Equal Opportunity Housing Plan approved by HUD. <br /> <br />SECTION 3. NOTICE OF NEED FOR ISSUANCE OF VOUCHERS <br /> <br />The City agrees to carry out its Rental Rehabilitation Program in <br />accordance with the schedule in its RRP Contract, Exhibit C, and will <br />give the PHA notice of the actual need for issuance of Section 8 Vouchers <br />needed for the relocation of low income families wishing to move from <br />recently rehabilitated units under the TRRP. PHA will use <br />vouchers/certificates from their existing program if any. <br /> <br />E)(HLBlIA ~ <br />
