I There are no unique conditions or features of the property which is not generally common to <br />other properties. <br />2. The literal compliance with Sections VIII (E) 14 & 15 of the Subdivision Ordinance would <br />cause unnecessary hardship given the fact that the roadway to be constructed will not be a <br />collector street, but rather a local residential street with a cul-de-sac. <br />3. The granting of the variance will not violate the spirit or the intent of this article. <br />4. The condition or feature which creates the need for the variance did not result from the property <br />owner's own actions, but rather is a conflicting requirement within the City's Subdivision <br />Ordinance Requirements. <br />5. The variance by the applicant is not solely for personal convenience, financial hardship, or <br />other reasons unrelated to the property. <br />Chairperson RuthAnn Alsobrook, asked for clarification on the definition of a Collector street . <br />Director Mack explained Collector Streets typically allow Feeder Streets to tie in and carry a larger <br />volume of traffic. In connection with this Application, Director Mack offered his opinion that the <br />construction of such street would be unnecessary; a waste of resources; and would trigger more <br />variances for lot depths. <br />Board Member Larry Walker asked if it is appropriate for the variance to be granted even though <br />the Final Plat has not been approved. Director Mack responded hat since the project is still in the <br />preliminary stages that it is the correct sequence for the variance approval to be made before the <br />Final Plat submittal. <br />Board Member William Sanders asked if the approval of the narrower ROW will limit access for <br />trash pickup or emergency services. Director Mack confirmed it would not. <br />Chairperson RuthAnn Alsobrook stated that the improvement of this lot would substantially <br />increase the value of this lot and generate tax revenue. She also asked if the neighboring streets <br />would be able to withstand the increased traffic to which Director Mack confirmed they would. <br />Public hearing was declared open. <br />No one else spoke in favor or opposition. <br />Public hearing was declared closed. <br />Motion was made by Larry Walker, seconded by William Sanders to approve the variance to <br />Subdivision Ordinance Sections VIII (E) 14 & 15 required 60' required ROW Collector Street to <br />50' ROW Local Street and 39' paving width to 29' based upon the 5 staff recommended findings <br />of fact. Motion carried 5:0. <br />
