5. Public hearing to consider and take action on the petition of Shawn Coyier, on Lot Pt of 1, City Block 321, being located at 2315 NE Loop 286. The applicant requests a variance of Article 4.10, Sections 4.10.003(e), 4.10.004(a)(1), 4.10.009(a), 4.10.009(b) and 4.10.081 of the Sign Ordinance which provides as follows: - Section 4.10.003(e) — "Sky signs are prohibited except as provided in division 2 [Historical Downtown District] of this article. " - Section 4.10.004(a) (1) — "Attached signs shall not extend above the roofline of the building or more than twelve (12) inches from the building wall. Where the building fascia is not vertical, the bottom of such sign shall not project more than twelve (12) inches from the fascia and the sign can be oriented in a vertical manner. - Section 4.10.009(a) — "All signs and sign structures shall be designed, constructed, and inspected in accordance with this section. " - Section 4.10.009(b) — "Signs and sign structures shall be designed and constructed to comply with the provisions of the building code for use of materials, loads and stresses to withstand a wind pressure of thirty (30) pounds per square [foot]. " - Section 4.10.081— "No temporary or permanent signor billboard to be installed or located within the corporate city limits shall be erected, constructed, reconstructed, relocated or placed within the city unless a permit shall have been first secured from the building official. " Shawn Coyier (Applicant) is proposing a "sky sign" at 2315 NE Loop 286. Public hearing was declared open. Stephanie Harris, City Attorney, made an opening presentation. She mentioned that this application for the "sky sign" variance(s) had previously come before the Board and the application was denied. However, newly discovered data suggest that notice to the Applicant of the previous hearing might not have been effective. Therefore, the City has determined to bring the application back before the Board to avoid any possible due process (notice) problems. City Attorney Harris then proceeded to present the variance application to the Board, and concluded with a recommendation that the application be denied on all requested variances. Shawn Coyier (Applicant), of 4075 Vista Ridge Drive, notified the Board that the sign was actually put up on January 181h which was Martin Luther King Day. Applicant had planned to install the sign on the 181h of January because the installation equipment was on site. City offices were closed on January 18th, so Applicant decided to apply for the permit on January 19tH
