<br />RESOLUTION NO. <br /> <br />86..,044 <br /> <br />WHEREAS, the City Council of the City of Paris did <br />heretofore approve the Plat - Showing Easements, Part of Lot <br />1, Lot 2A and Lot 3, City Block 313, on the 7th day of <br />November, 1985, which plat is recorded in Envelope 280-C, <br />Plat Records, Lamar County, Texas, which shows thereon a SO <br />foot easement adjacent to the East boundary lines of Lots 2B <br />and 2C which easement has never been used by the public and <br />was never opened to the public and that no public road or <br />street construction has occurred upon such SO foot easement; <br />and, <br /> <br />WHEREAS, it is not the custom or practice of the City <br />of Paris to accept easement dedication for the purpose of <br />construction of public streets, the usual and customary <br />method being the dedication of or granting of by Right- <br />of-way Deeds; and, <br /> <br />WHEREAS, it is found that the SO foot easement shown <br />adjacent to the East side of Lots 2B and 2C of the Plat <br />recorded in Envelope 280C is hereby found to serve no public <br />purpose and therefore, it would be right and proper to <br />close, abandon and vacate the same and for the Mayor of the <br />City of Paris to execute a Quit Claim of said easement to <br />David W. Glass and Centerpoint, Ltd.; NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, That the SO foot easement depicted on the Plat - <br />Showing Easements, Part of Lot 1, Lot 2A, and Lot 3, City <br />Block 313 heretofore approved on the 7th day of November, <br />1986, is closed, abandoned and vacated; and, <br /> <br />BE IT FURTHER RESOLVED, That the Mayor, Billy Joe <br />Burnett, be and he is hereby authorized and directed to <br />execute on behalf of the City of Paris the quit claim deed <br />to David W. Glass and Centerpoint, Ltd. in the form of <br />Exhibit A attached hereto; and, <br /> <br />BE IT FURTHER RESOLVED, That the 20 foot easement <br />depicted on the Final Plat of Lot 2C and Part of Lot 3, City <br />Block 313 (3.763 Acres) to be recorded in the Plat Records <br />of Lamar County, Texas, is accepted, which plat was <br />presented and executed by the owners of all of the property <br />effected thereby being David W. Glass and Centerpoint, Ltd., <br />partially modifies the plat heretofore recorded in Envelope <br />280-C, Plat Records, Lamar County, Texas. <br /> <br />Passed and adopted this 12th day of May, 1986, <br /> <br /> <br />ATTEST: <br />
