Discuss and act on RESOLUTION NO. 2022-028: A RESOLUTION OF THE CITY <br />COUNCIL OF THE CITY OF PARIS, TEXAS, TO WAIVE PRINCIPAL AND <br />INTEREST ON A DANGEROUS STRUCTURE ABATEMENT LIEN ON PROPERTY <br />DESCRIBED AS CITY OF PARIS BLOCK 155, LOT 3, LOCATED AT 503 W. <br />WASHINGTON STREET TO FACILITATE SALE OF THE PROPERTY TO AN <br />ADJACENT NEIGHBOR; MAKING OTHER FINDINGS AND PROVISIONS; AND <br />DECLARING AN EFFECTIVE DATE. <br />City Manager Grayson Path said Mr. Pena's proposal was in their agenda packets. Mr. <br />Path explained that in January 2013, the City demolished a dangerous structure located at 503 W. <br />Washington, applied a lien against the property that continued to accrue with interest, totaling <br />$15,373.09. Mr. Path said according to Mr. Pena, the previous owner of the property had passed <br />away, and he was working with the heirs who were willing to sell him the property for <br />$1,000.00. He also said no taxes were owed on this property. Mr. Path explained that only the <br />City Council could waive a Structure Lien. He also said the value of the lien (principal plus <br />interest) greatly exceeds the value of the property, although the value of the property exceeds the <br />value of the principal of the lien. Mr. Path asked Mr. Pena to come forward. Mr. Pena said <br />when they purchased 503 W. Washington, they were unaware that they did not own the driveway <br />they were using to access their property but learned this when a survey was done. He said there <br />had been problems with the neighbors who owned the driveway, and allowing them to use the <br />driveway. Mr. Pena said the best solution was for them to purchase the property located at 503 <br />W. Washington and put in a driveway to access the property they had purchased which has a <br />home on it. <br />Mr. Path reviewed the options with City Council which were to: 1) approve a Resolution <br />for the Waiver of the January 11, 2013, Structure Lien for 503 W. Washington Street, 2) approve <br />a Resolution for the waiver of a portion of the January 11, 2013 Structure Lien for 503 W. <br />Washington, 3) Request a development agreement be created where the owner pays all or a <br />portion of the lien upfront, release the lien, and upon completion of the work reimburse the <br />payment amount to Mr. Pena; and 4) do not waive any portion of the lien. <br />Council Member Savage inquired who was responsible for the lien at this time, and Mr. <br />Path said it was the current owner and that the lien carries with the property. Council Member <br />Savage expressed concern about waiving this lien and then the property is sold to someone else. <br />Mr. Path said they could include language in the resolution to that fact. City Attorney Stephanie <br />Harris said she could revise the resolution to include language that the lien for the principal and <br />interest would be waived contingent up the sale of property to Mr. Pena. <br />A Motion to approve the resolution waiving principal and interest on a dangerous <br />structure abatement lien on property located at 503 W. Washington Street, contingent upon the <br />
