See <br />Exhibit D hereto attached as an example of how this charge <br />will be calculated. <br /> <br />VII. <br />MIS C ELL A N E 0 U S <br />A. LCWSD will construct a ground storage <br />facility at a location near the City's Water Treatment Plant <br />and will connect such facility to the City's water system in <br />such a manner that will eliminate its present North, North- <br />east and East meters. Except for emergency short term use <br />due to such things as LCWSD's transmission lines breaking, <br />power failure, mechanical failure and Act of God, City will <br />control the use of meters at these locations by LCWSD. <br />City will deliver potable water to a point of connection to <br />LCWSD's facility and at a minimum pressure of 30 pounds. <br />B. In the event of short term non-recurring <br />emergencies and shortages, the City retains the right to <br />reduce water quantities identified herein in the same ratio <br />as it reduces the amount delivered to other system users. <br />C. Both parties agree that LCWSD will not expand <br />its water services to property and users in the gray area <br />without permission of the City. Other than as provided by <br />law, the City will have no right to purchase LCWSD's water <br />facilities in the gray area added during this contract <br /> <br />16 <br />
