Item No. 15 <br />TO: Mayor, Mayor Pro Tem and City Council <br />Grayson Path, City Manager <br />FROM: Andrew Mack, AICP Director Planning & Community Development <br />James Hooten, Assistant Building Official <br />Cheri Bedford, Historic Preservation Officer <br />Robert Talley, Code Enforcement Supervisor <br />SUBJECT: Rental Registration and Vacant House Registration for Residential Rentals in <br />All Historic Overlay Districts <br />DATE: May 5, 2022 <br />BACKGROUND & DISCUSSION <br />Over the past year staff has been undertaking a parallel project to the vacant residential registration <br />requirements; and a new rental licensing program for every residential rental property in all <br />Historic Districts. This initially developed in response to concerns that were brought to, staff's <br />attention regarding neglect and other nuisances inside and around the yards of occupied rental <br />properties and in the South Church Historic District 2. Accordingly, a project team was assembled <br />including staff from the Community Development, Engineering, Fire and City Administration <br />Departments. On March 9, 2022 the staff team made a presentation to the Historic Preservation <br />Commission (HPC). The HPC sent a unanimous recommendation to the City Council for adoption <br />of the ordinance changes and implementation of the new rental housing inspection program and <br />vacant residential structure ordinance amendments. There were also several residents in <br />attendance who spoke in support of the proposed changes to the Historic District Overlay <br />regulations. Their primary reasons for support was to further protect and enhance the overall <br />quality of residential properties located within all HPC Overlay Districts 1-16, including those <br />added in the future. <br />The attached draft ordinance provides for a licensed registration requirement, including inspection <br />of the property every 2 years for all residential dwelling units in HPC 1-16. It also imposes <br />limitations on how many people can occupy a dwelling based upon the square footage of sleeping <br />quarters in a residential dwelling according to the 2022 International Property Maintenance Code <br />(IPMC) which is also adopted for these regulations within the Historic Overlay District. It will not, <br />however, apply to the entire City Limits at this time. Most importantly, it provides for the bare <br />minimum life safeft requirements to be met as a part of the new bi-annual inspection program. <br />Page 1 of 2 <br />
