ORDINANCE NO. 2022-038 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, <br />TEXAS, ESTABLISHING A HISTORIC OVERLAY DISTRICT NO. 18 (HD - <br />18), IN A TWO FAMILY DWELLING DISTRICT (217) IN THE CITY OF <br />PARIS, BLOCK 146, LOT 3, LOCATED AT 705 SE 3RD STREET AND <br />DESIGNATING THE STRUCTURE ON SAID PROPERTY AS A HISTORIC <br />STRUCTURE IN ACCORDANCE WITH THE RECOMMENDATIONS OF <br />THE PLANNING AND ZONING COMMISSION AND THE HISTORIC <br />PRESERVATION COMMISSION; PRESERVING THE EXISTING USE AND <br />ZONING DESIGNATIONS OF THE PROPERTY SO DESIGNATED; <br />DESIGNATING THE BOUNDARIES OF THE HISTORIC OVERLAY <br />DISTRICT NO. 18 (HD -18) SO ESTABLISHED; MAKING OTHER <br />FINDINGS AND PROVISIONS RELEATED TO THE SUBJECT; <br />PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A <br />SAVINGS CLAUSE, A PENALTY CLAUSE; AND DECLARING AN <br />EFFECTIVE DATE. <br />WHEREAS, the City Council of the City of Paris, Texas, has received a request <br />from the Paris Historic Preservation Commission for an amendment to the zoning <br />ordinance of the City of Paris to establish a Historic Overlay District (HD) on City of <br />Paris, Block 146, Lot 3, located at 705 SE 3rd St.; and <br />WHEREAS, the structure located on said property has been identified as the <br />oldest standing residence in the City and was constructed in 1880 with an Italianate <br />architectural style; and <br />WHEREAS, on May 11, 2022, the Historic Preservation Commission reviewed <br />the request, and, after notice to the owner and a public hearing thereon, <br />recommended that the Historic Overlay District on this property be approved in <br />accordance with the City zoning ordinance and State law and that the City Council <br />designate the structure as a historic structure; and <br />WHEREAS, on June 6, 2022, the Planning and Zoning Commission conducted <br />a public hearing on said proposed amendment to the City zoning ordinance and, <br />following said hearing, made formal recommendation to the City Council regarding <br />said proposed Historic Overlay District No. 18; and <br />WHEREAS, on June 27, 2022, the City Council of the City of Paris subsequently <br />conducted a public hearing on the aforesaid proposed amendment to the City zoning <br />ordinance, and having considered the recommendations of the Planning and Zoning <br />Commission and the testimony and evidence introduced at said public hearing, found <br />and determined that the residence on the property represents significance in history, <br />architecture, and culture and that a historic overlay district would be appropriate for <br />the property. <br />
