10. Consideration of and action on the Preliminary Plat of the Warren 174-A Addition, <br />Lot 1, Block A, LCAD Property ID 16781, located at 1202 Martin Luther King Jr. <br />Dr. <br />Derrick Dacus (City of Paris Engineering Technician) stated that the parcel is 4.447 <br />acres located at 1202 Martin Luther King Jr. The zoning is currently S172. The <br />owner has submitted a preliminary plat to develop a home. The following issues <br />are sited: The center line North of Martin Luther King Jr. Dr. of the proposed <br />location needs to be shown. According to the subdivision ordinance with all <br />existing dedicated streets, alleys within or adjacent to the proposed structure should <br />be shown. According to the master thoroughfare plan Martin Luther King Jr. Dr. is <br />a collector road way. This requires the right of way to be 60 ft. in width. The <br />distance from the center line to the Northern property line needs to be 30 ft. of <br />dedication which is not shown. It is listed as 50 foot right of way which is in <br />contradiction to what we are seeing on LOAD. This needs to be verified on the plat. <br />If required right of way dedication needs to be shown and properly documented, <br />this should include setting, calling out pens and updating the acreage to reflect any <br />loss of any dedicated right of way. The right of way note for 12th street has been cut <br />off the page and needs to be shown also if the width of this is coming from the <br />unreported plat reference in this description, it's not a legally binding description <br />and is therefore not a legal acceptable reference. There are existing utilities that <br />have not been shown per subdivision ordinance Section 4, Item 7 the location size <br />of all existing utilities should be shown. Per subdivision ordinance Section 4, Item <br />9 the proposed plans of subdivisions shall show streets names, easements, alleys, <br />blocks, lots, building lines, etc. with dimensions. The rear set back lines need to be <br />shown and labeled and there's a 5 foot utility easement on the West and East of the <br />property that has been shown on the plat but has been terminated before the end of <br />the property line, it needs to extended to the end of the property line. The 25 feet <br />building line on the North edge of the proposed subdivision shall not extent into the <br />5 foot utility easement on the West and East end. There's an existing sanitary sewer <br />line that runs diagonally across the property, if there is an easement, and there <br />should be. This easement has not been shown and if there's not an existing easement <br />there needs to be one called out. 15 foot easement 7.5 on both sides of the line. <br />There needs to be a correction made on the field notes on paragraph 5 which states <br />south 89 degrees blank minutes 59 seconds west with the south line, etc. with the <br />bearing found on the south line 6 shown in the unrecorded plat South 89 degrees <br />12 minutes 57 seconds. The description of the signer needs to modify to match the <br />paragraph subdivision ordinance. Which would read Chairman, City of Paris <br />Planning and Zoning Commission per the subdivision ordinance. The notes stating <br />that the subdivision plat is for the inspection purposes only. Also the field notes and <br />needs to be relocated. <br />City Staff recommendation: Due to the number of issues and the nature of some <br />of these issues Staff recommends denial of this preliminary plat. <br />Discussion of consistency of plat items, consistent with other houses, failure to <br />comply and correct plats, surveyor re -accessing the plat and reapplying, to many <br />loose ends, staff not comfortable recommending approval, reapplying fees. The <br />commission is sympathetic towards owner and would like the re-application fee be <br />
