fronting 34th street and the presented variance is for the extension of the fence along the side, <br />front yard on 34th street. Lastly, Mr. Mack stated that the staff recommends denial because the lot <br />is platted with a 20' setback and the construction of the fence would create an obstruction to <br />visibility on a street that is often traveled on at a higher speed that what is posted making the <br />fence an increased safety hazard if constructed. <br />Ms. Alsobrook declared the public hearing open. <br />Staff member, Paige Unger, made note of input forms as follows: <br />Roger and Sharon Stripland of 3420 Clement Road, applicant present to elaborate in testimony. <br />Sharon Stripland of 3420 Clement Road, stated that the rear fence was permitted and inspected in <br />May of 2020; the fence was placed to separate them and their neighbor's yard since it is often <br />overgrown. Ms. Stripland continued that they would like to extend the fence along the side <br />frontage and connect to the back corner of their house to give themselves privacy for their <br />backyard since they have a pool. Ms. Stripland exlplained that safety of the road would not be <br />impacted by the construction of the fence since their existing home obstructs the view of the <br />corner and it is already an unsafe road; she believes that a solution would be for the city to make <br />it a corner with a stop sign. Lastly, Ms. Stripland stated that placing the fence on the 20' setback <br />would significantly decrease their yard, not look aesthetically pleasing or uniform with their <br />neighbors and would be more difficult to mow. <br />There was discussion amongst the board and the applicant about the setback, placement of the <br />fence and safety of the road. <br />Clyde Davis of 3440 Clement Road, spoke in favor of the request. Mr. Davis spoke about how <br />the road is unsafe, but that is often because people are speeding and do not look in the line of <br />sight. Mr. Davis also mentioned that the proposed placement of the fence will not damage the <br />tree, will provide privacy and will prevent foot traffic from cutting across their backyards. <br />Lastly, the openness of the fence will not be a concern since his backyard is open and will allow <br />air and light to pass through. <br />Russell Davis of 3440 Clement Road, spoke in favor of the request. Mr. Davis stated that he does <br />not believe the line of sight is the concern, but that the road is just simply unsafe since he <br />personally has been ran off the road by speeding vehicles. <br />Paula Portugal of 2020 NE 38th Street, spoke in opposition of the variance and believes that the <br />fence will obstruct the line of sight on this already dangerous road. <br />No one spoke in favor or opposition of the request. <br />Public hearing was declared closed. <br />
