There was discussion amongst the board and Mr. Mack about the anchoring of the sign when it is <br />placed. <br />No one else spoke in favor or opposition of the request. <br />Public hearing was declared closed. <br />Motion was made by David Hamilton, seconded by Jerry Harting to approve the .401 acre variance <br />to Section 4.10.005(1)(D) of the Sign Ordinance to allow a 200SF development sign on a 4.6 acre <br />lot versus the required minimum 5 acre lot based on the following staff recommended findings. <br />Motion carried 5-0. <br />STAFF RECOMMENDED FINDINGS <br />1. The request for variance is harmony with the general purposes and intent of Zoning <br />Ordinance No. 1710, as amended, and will not negatively impact the protection for the <br />adjacent surrounding property. <br />2. The request is to permit a temporary development sign for a permitted use in the C District <br />which is not applicable with regard to a non -conforming use. <br />There are special and unique conditions related to the request regarding lot size, narrow road <br />frontage, safety conditions of Loop Highway pertaining to the development of the site which <br />support the need for a larger sign for a number of reasons, but principally safety as related to <br />the permitted size of the sign. <br />4. The hardship sought to be avoided is not the result of (a) the applicant's own actions (self- <br />imposed or self-created although unintentional), but rather for safety factors. (b) There is no <br />economic or financial hardship. The substandard parcel lot depth is a result of the <br />undeveloped property available for this development. <br />5. The provisions of Zoning Ordinance No. 1710, and its amendments, that are sought to be <br />varied would deprive the applicant of the normal rights to use the property that is commonly <br />enjoyed by other similar sized properties along this entire NE segment of Loop 286 and the <br />same C Zoning District. <br />4. Public hearing to consider and take action on the petition of Roger and Sharon Stripland, <br />regarding variances to the City of Paris Building Regulations, Article 4.11 Fences, Lot 1, <br />Block A, of the Armstrong Addition, being located at 3420 Clement Road, sections as <br />follows: <br />1) 4.11.003(b)(1)(C)- 2'6" variance to fence height. <br />2) 4.11.003(b)(1)(D)- Variance to allow solid, wooden privacy fence. <br />Andrew Mack, Director of Planning & Zoning, presented case to the board. Mr. Mack stated that <br />a 6' fence has already been constructed along the rear property line up to the side property line <br />
