Regular Council Meeting <br />August 22, 2022 <br />Page 8 <br />A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE <br />DATE. <br />Planning Director Andrew Mack said the applicant was proposing to develop a Planned <br />Development District with three uses, which were Commercial/Retail along Lamar Avenue, <br />Multi -Family Senior Housing in the center, and Single -Family detached housing. Mr. Mack <br />recommended that approval of the amendment subject to three conditions: 1) all additional <br />required permits and plat approvals be obtained; 2) the business owner is to comply with all <br />required Federal, State, and Local laws; and 3) no clear -cutting of any mature trees and <br />vegetation upon the Planned Development District (PD) rezoned property or the non -rezoned <br />Agricultural District (A) property for future single-family residential under the same ownership <br />by the applicant, unless a tree removal and landscape buffering plan is first approved by the <br />Director of Planning and Community Development. Mr. Mack explained the project was <br />granted housing tax credits by the Texas Housing Commission in July, and the zoning must be <br />approved for the multi -family project now that the grant funding was approved. He said the <br />applicant requested approval by the Planning & Zoning Commission and it was approved at their <br />meeting of July 5, 2022. <br />Mayor Portugal opened the public hearing and asked for anyone wishing to speak in <br />support or opposition of this item, to please come forward. Developer Mr. Naul depicted <br />photographs of the proposed project, which was comprised of senior apartments. Mr. Naul said it <br />would be a gated community with many amenities. He also said he was excited to be in Paris <br />and about this project. With no one else speaking, Mayor Portugal closed the public hearing. <br />Council Member Pankaj said this was a great project. Mayor Portugal said this project <br />was in her district and she very supportive of it. Mayor Pro -Tem Hughes said he was excited <br />about this project. <br />Subject to the three conditions recommended by City Staff, a Motion to approve this item <br />was made by Council Member Pankaj and seconded by Council Member Savage. Motion <br />carried, 7 ayes — 0 nays. <br />24. Discuss and act on Amendment No. 2 to the Agreement for Professional Services with <br />Garver for Engineering of the Wastewater Treatment Plan Project, with this amendment, <br />the total contract fee is not to exceed $8,836,142.52. <br />Utilities Director Doug Harris explained that due to the magnitude and complexity of this <br />project, City management and staff had determined construction administration and observation <br />are essential components for successful completion of the treatment facility through on-site, real- <br />time construction observation and inspection services. Mr. Harris said the contract amendment <br />allowed for inclusion of these construction services to protect the City from defects and/or <br />deficiencies in work performed by the Contractor. <br />Mayor Portugal confirmed inspections would be done by a third party. Council Member <br />Pilgrim and Council Member Pankaj said this made sense and should be done. Mayor Pro -Tem <br />Hughes said he was in full support. <br />
