DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS <br />RE: 423 N Main Street- Variance Request <br />Marx Offutt <br />4808 CR 22880 <br />Paris, TX 75460 <br />ACTION REQUESTED: 6' variance to eliminate the minimum, required landscaping buffer on <br />the North and South sides of the property. <br />The above -reference request was granted with conditions by the City of Paris Zoning oard of <br />Adjustment (`Board") on 9/6/2022 by a vote of ayes,m nays and <br />abstaining. On this date, the Board found that the request met the conditions set forth in the <br />Buffering Regulations, Section 30-102(3) of the City of Paris Zoning Ordinance. <br />Appeal: Any interested person wishing to appeal this Board decision is required to file a petition <br />for Writ of Certiorari in a district court, county court or county court at law within ten (10) days <br />of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas <br />Local Government Code. <br />The Board of Adjustment here by grants the variance request based upon the following conditions <br />and findings of fact. <br />CONDITIONS: <br />1. Existing asphalt in area that would have become landscaping buffer now has to be treated as <br />all parking areas requiring it to be swept. <br />2. Existing asphalt in area that would have become landscaping buffer now has to be treated as <br />all parking areas requiring it to be seal coated. <br />3. The above conditions be completed prior to issuance of the Certificate of Occupancy. <br />4. A green space containing grass, adjacent to the existing sidewalk, will be created and <br />maintained by the applicant. <br />BOARD RECOMMENDED FINDINGS <br />The request for variance is in harmony with the general purpose and intent of the Zoning <br />Ordinance and maintains the spirit and intent of the Off -Street Parking Requirements and <br />
