RESOLUTION NO. 84 -023 <br />WHEREAS, the City Council of the City of Paris has <br />received a project plan for projects entitled Landfill <br />Closure and I & I Flow Equalization Basin Projects which, if <br />approved, will be described in plans and specifications <br />prepared by the City of Paris Department of Engineering and <br />consultants as needed and approved under said departments <br />direction; and, <br />WHEREAS, the project consists of two phases. Phase I <br />being the landfill closure directed by the Judgment entered <br />on the 26th day of September, 1983 in Cause No. 49477 in the <br />6th Judicial District Court of Lamar County, Texas. Phase <br />II is the construction of the I & I Flow Equalization Basin, <br />consisting of pump station and piping for the purpose of <br />eliminating the by -pass overflow into Pine Creek as directed <br />in EPA Order on Consent authorized in Resolution No. 84 -017; <br />and, <br />WHEREAS, the property descriptions of the property <br />required for the completion of said projects are shown on <br />Exhibit A attached hereto; and, <br />WHEREAS, the City Council finds that the property <br />described on Exhibit A attached hereto as five tracts and <br />one temporary easement are necessary for said ordered <br />projects and that the same should be condemned; NOW, <br />THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, that the City Attorney, T. K. Haynes, be, and he is <br />hereby authorized and directed to proceed with the aid of <br />outside counsel to condemn the above described property to <br />be used for Phase I and Phase II of the Landfill Closure and <br />I & I Flow Equalization Basin Projects. <br />Passed and adopted this 9th day of April, 1984. <br />OwAalvyt'�) <br />J e Graham, Mayor <br />ATTEST: <br />H. r Gr ne, City Clerk <br />APPROVED AS TO FORM: <br />T.
